The total estimated value of the proposed BPA is $20 million for a period of performance of five (5) years.

4. The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

This acquisition is conducted under the authority of the Multiple-Award Schedule Program 41 U.S.C. 251, et seq., and Title 40 U.S.C. 501, Services for Executive Agencies. The rationale for limiting consideration to schedule contractors is FAR 8.405-6 (a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

The Lenco Bearcat is the SWAT operation standard and only known commercial off the shelf vehicle offered on the GSA schedule that meet the specific needs of the FBI. Below are the unique capabilities or qualifications of the Lenco Bearcat armored vehicle that meet the Government’s requirements and form the basis for this justification:

1. The Bearcat is built on a commercially available standard F-550 chassis that has a condensed wheelbase between 126"-131." The shortened wheelbase requirement is imperative as it improves the turning radius of the vehicle which is vital during a tactical operation.

2.

the reduced turning radius required to maintain stability while rapidly maneuvering in confined settings. The environments, weather, and terrain deployed to, are often unfamiliar and the salient characteristics described increase mission capability to rapidly egress and maneuver which are an operational necessity for Agent safety and successful operations.

3. The FBI requires a vehicle that offers multiple hit ballistic protection for high powered rifles/ammunition which have become increasingly available on the commercial market.

While there are other companies offering various types of armored vehicles under Federal Supply Schedules in the commercial marketplace, Lenco is the only source capable of providing the supplies or services required to meet the technical specifications detailed within the Statement of Work.

5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).

By placing an order against a schedule contract using the procedures in 8.405, the Contracting Officer has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, re-training personnel, etc.) to meet the Government’s needs. GSA has determined the prices of supplies offered to be fair and reasonable for the purpose of establishing the schedule contract with GSA contractors. The Contracting Officer will seek additional discounts before placing an order. Additionally, the Contracting Officer will use the proposal analysis techniques at FAR 15.404-1 to negotiate a fair and reasonable price.

6. A description of the market research conducted among schedule holders, and the results of the research. A statement must be made that the supplies and services are available from the FSS.

Market Research was conducted in June - August 2021. Various methods of Market Research were conducted to include 1) GSA Market research request for information (RFI) #s RFQ1496546, RFQ1496547, RFQ1496548 (GSA posts RFIs by using RFQ numbers) posted on June 8, 2021, 2) searching the internet, 3) reviewing System for Award Management (SAM) website, and 4) contacting knowledgeable individuals in Government and Industry.

The FBI requested GSA to conduct Market Research for the armored vehicle requirement. GSA provided the FBI with a Market Research report on June 10, 2021. Out of the 38 vendors for SIN 336992 seven (7) vendors responded to the request for information. A review of the responses was conducted by the technical expert. The technical expert reviewed the data and conducted additional interviews with the vendors and learned that the vendors did not have the capability to meet the armored vehicle requirements.

Additional Market Research was conducted by contacting other Federal Contracting Personnel in other federal agencies and reviewing the SAM website. In the interviews with the Contracting Officers, they provided that Lenco’s Bearcat Armored Vehicle was the only armored vehicle capable of meeting their specific requirement including a condensed wheelbase between 126"- 131". On SAMs, Limited Source Justifications from within the past two years can be found from Federal Offices such as the U.S. Department of Justice, General Service Administration (GSA), and the U.S. Department of Homeland Security U.S. Immigration and Customs Enforcement stating the same findings that the Lenco Bearcat is the only armored vehicle to meet the requirement of a condensed wheelbase between 126"-131".

The conclusion of the market research was Lenco is the only vendor capable of meeting the FBI requirements. Lenco’s tactical armored vehicle was the only tactical armored vehicle that had a condensed wheelbase between 126"-131". No other vendor that responded to the RFI or found

Requisition Number: DJF-2100-PR-00038120001 Version 2.1 Page 5 of 7 during independent market research, could provide this wheelbase or were willing to reduce the wheelbase dimensions from stock units to meet the requirements.

Lenco Bearcats are available from the GSA Federal Supply Schedule (FSS) number 084, Special Item Number (SIN) 336992.

7. Any other facts supporting the limited source justification.

8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

The FBI will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements with interaction with other federal and state agencies, review of databases, and ongoing outreach to vendors.
