JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command-Norfolk (MSC), 471 East C. Street Norfolk, Va. 23511.

2. Description of Action Being Approved: MSC Norfolk has a requirement for Shore Based Spares ECR Panels for Main Diesel Engines for the T-AKE Class of vessels.

3. Description of Supplies/Services: This requirement covers the procurement of twenty-eight

(28) Main Diesel Engine ECR Panels for T-AKE Class of vessels. These parts are needed for Shore Based Spares (SBS) of Long Lead Time Material (LLTM) from the OEM, or authorized OEM providers only, for these engines. SBS LLTM will be used to rapidly replace equipment after failure in service.

4. Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority for this procurement is the test program for commercial items (Section 4202 of the Clinger Cohen Act of 1996) implemented at FAR 13.501 and FAR 13.106-1(b).

5. Rationale Justifying Use of cited Statutory Authority: Under Military Sealift Commands Safety Management System Procedure Number: 10.6-002-ALL, lists all four main propulsion diesel engine (MPDE) as critical equipment. The engine OEM is Man Diesel, Germany for the T-AKE class ships. Fairbanks- Morse Engine (FME) and Motor-Services-Hugo-Stamp (MSHS) are the OEM authorized suppliers of approved repair parts for T-AKE class main engines. There are no other known vendors who may provide these engine parts. Failure of one MPDE will force the ship to reduce their speed. The loss of two engines put the ship in a c-4 status, thus becoming unable to perform the primary mission of providing underway replenishment services to the fleet, which will result in a CASREP. The reduction of speed can also pose a hazard to the crew, due to limited ship maneuverability. Proper refurbishment and maintenance of engines are critical to the safe operations of T-AKE vessel. FME and MSHS provide parts and technical data / drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures engine reliability, and crew safety.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:

7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3.

8. Actions to Remove Barriers to Future Competition: Currently the OEM and its authorized vendors are the only viable source for the requirement. MSC is committed to researching alternatives within the market place in an attempt to develop competition amongst all possible vendors.
