JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

LIMITED SOURCE

1. Agency and Contracting Activity.

Marine Corps Installations Pacific, Regional Contracting Office (MCIPAC RCO)

2. Description of the Action Being Approved.

The authority sought by this J&A is the approval to award a three (3) month bridge contract to the incumbent contractor, Booz Allen Hamilton Inc., for the continuing need of Technical and Operational Advisory support in the Logistics and Technical Support Services, Facilities Requirements Planning and Assessment, and Environmental Requirements Planning and Assessment Domains, III Marine Expeditionary Force (MEF) Defense Policy Review Initiative (DPRI) Okinawa, Japan.

3. Description of Supplies/Services.

Contract M67400-17-P-0002 was awarded to Booz Allen Hamilton Inc., on 23 November 2016 in the amount of $3,685,366.20. The requirement was competed via open market and awarded as a Firm Fixed price. It includes a base period of one year, two (2) one year option periods, and a six (6) month FAR 52.217-8, option to extend the services, ending on 11 June 2020.

This J&A authorizes and approves the award of a bridge contract to Booz Allen Hamilton Inc., to provide Technical and Operational Advisory to support to the III MEF DPRI Program Management Office (PMO) with regards to the movement of III MEF assets and infrastructure.

The services include operational planning support; review of associated and supporting construction plans, designs, and schedules.

The Following illustrates the anticipated Period of Performance (PoP) and the estimated total cost:

4. Statutory Authority Permitting Other Than Full and Open Competition.

This request is submitted pursuant to the authority of Title 10 U.S.C. 2304(c) (1), which provides that full and open competition need not to be obtained where there is “only one responsible source and no other supplies or services will satisfy the agency requirements” FAR 6.302-1.

Specifically, per FAR 6.302-1(a)(2)(iii)(B), this request asserts that “services may be deemed available only from the original source in the case of a follow-on contract for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements.”

5. Rationale Justifying Use of the Cited Statutory Authority.

Pursuant to the above authority, Booz Allen Hamilton Inc., is the only responsible source of services that will satisfy the Government’s needs at this time, as described in paragraph 3 above.

Contract Performance is in Okinawa, Japan, and no other contractor is capable of performing the services given the short time the contractor will have to relocate its personnel to Okinawa, Japan.

Additionally the current travel restrictions and delays due to the Novel Coronavirus disease (COVID19) global impact adds new limitations to the prospective contractor capabilities to relocate to perform the services. Without the support the incumbent provides, the III MEF DPRI mission will be significantly affected by a lapse in services causing potential significant financial loss to the Government.

The MCIPAC RCO is in the process of awarding a new contract that consolidates contract M67400-17-P-0002 with one other existing contract that expires on or after 24 September 2020.

The Government conducted Market research during the planning phase, and the Government determined that requirements will be competed under the GSA One Acquisition Solution for Integrated Services (OASIS) Pool 1 Small Business. The solicitation for the new contract was posted on GSA OASIS Pool I on 27 March 2020 and multiple offers were received.

The III MEF DPRI depends on these services to support the III MEF DPRI program and must continue during the period required to award a new contract. No other offeror could provide these services. Furthermore, given the expected amount of time it would need to compete and award this bridge, it is expected that the awardee would require at least three months to deploy personnel and to get their personnel access to the Marine Corps Enterprise Network. That would result in an unacceptable delay in services until the beginning of September. The end date of this proposed bridge contract is 11 September.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

As required by Defense Federal Acquisition Regulation Supplement (DFARS) PGI 206.302-1, a Request for Information/ Sources Sought (RFI/SS) was posted via Beta.Sam.gov on 21 April 2020 and closed on 28 April 2020. Two (2) vendors submitted their capabilities statements, however as addressed in paragraph 5, the MCIPAC RCO would not be able to solicit and award a competed contract for a different company to perform the services starting 12 June 2020. A normal Procurement Administrative Lead Time (PALT) for a new requirement above $250,000 and less than $7M is about 120 days. Given that expected lead time, it would take significantly longer to compete this 90 day requirement than to even perform it. As mentioned in section 5 above, the requirements for a follow on contract is already being re-competed and it is in the pre-award phase.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable (FAR 13.5). The fair and reasonableness of the price will be based on the prices the contractor proposed under the current PoP, using historical prices from previous procurements that support the III MEF - DPRI and by comparing the prices with the current Independent Government Estimate (IGE).

8. Actions to Remove Barriers to Future Competition.

The MCIPAC RCO is in the process of awarding a new contract consolidating the needs under M67400-17-P-0002 with one other existing contract. The Government solicitation for the follow-on contract provided a fair opportunity to all GSA OASIS Small Business Pool 1 contractors.

The resulting award will be Firm Fixed price, with Cost Reimbursement Line Items for Travel and Contact Administration Fee (CAF). The Government will award to a single contractor for a base period of one year, four (4) one year option periods, and six (6) month FAR 52.217-8, option to extend the services.
