JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
FAR PART 6
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY (FAR 6.303-2(b)(1)). Bureau of Land
Management, Vale District Office, 100 Oregon Street, Vale, OR 97918.
2. NATURE/DESCRIPTION OF THE ACTION BEING APPROVED (FAR 6.303-2(b)(2)).
Procuring law enforcement services as a sole source to Malheur County Law Enforcement Services, to be procured as a firm-fixed-price service contract.
3. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS (INCLUDING
THE ESTIMATED VALUE) (FAR 6.303-2(b)(3)). Obtain law enforcement services, as needed, to assist the Bureau of Land
Management (BLM) in the administration and regulation of use and occupancy of the public lands administered by the BLM, within Malheur County, Oregon.
4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING THE OTHER THAN FULL AND OPEN
COMPETITION (FAR 6.303-2(b)(4)). The statutory authority permitting the other than full and open competition is 10 U.S.C.
2304(c)(1) or 41 U.S.C. 253(c)(1) under FAR 6.302-1 - Only one responsible source and no other supplier or services will satisfy the agency requirements.
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF
THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED (FAR 6.303-2(b)(5)). The Malheur County Sheriff’s
Office is the only responsible source that has jurisdiction to enforce the civil and criminal laws of the state of Oregon and
Malheur County on the public lands, waters, roads and trails administered by the BLM. Malheur County Sheriff’s Office deputies have undergone the required training as prescribed by the Oregon State Department of Public Safety Standards and
Training and the BLM law enforcement procedures and policies. Malheur County Sheriff’s Deputies possess the necessary qualifications and unique authority that other civilian security agencies will not have.
6. DESCRIPTION OF THE EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY
POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED
AS REQUIRED BY SUBPART 5.2 AND IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES (FAR 6.303-2(b)6)). No other sources will be sought for this service contract. The Malheur County Sheriff’s Office has demonstrated the unique and cooperative nature to perform the required services in conjunction with the minimum standards required by the Oregon State
Department of Public Safety Standards and Training and the BLM law enforcement procedures and policies. Soliciting other sources is not practical or possible.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT
WILL BE FAIR AND REASONABLE (FAR 6.303-2(b)(7)).
8. DESCRIPTION OF MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE RESULTS OR A STATEMENT
OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED (FAR 6.303-2(b)(8)). )).
10. LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION
(FAR 6.303-2(b)(10)). None
11. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS
TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISTIION FOR THE SUPPLIES OR SERIVCES REQUIRED.
(FAR 6.303-2(b)(11)). No further action will be taken to seek competition.
12. CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS ACCURATE AND COMPLETE TO
THE BEST OF THE CONTRACTING OFFICER’S KNOWLEDGE AND BELIEF. (FAR 6.303-2 (b)(12)). See certifications below.
