SECTION 1

INFORMATION TO PROSPECTIVE QUOTERS

This is a combined Synopsis/Solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;

proposals are being requested and a written solicitation will not be issued. Firm, fixed-price quotes are requested under Request for Quotation (RFQ) Solicitation number L15PS00450. This document incorporates provisions and clauses which are in effect through Federal Acquisition Circular (FAC) 2005-82. This solicitation is set-aside for small business under North American Industry Classification System (NAICS) code 115310. The Small Business Annual Receipts for the firm and its Affiliates, for the preceding three (3) fiscal years does not exceed $19.0 Million.

SITE VISIT

(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.

(b) Only one site visit will be conducted by the Bureau of Land Management as follows:

DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

Pole Creek Unit #15-1, 2, 3, Slashing and Girdling

1.0 STATEMENT OF WORK

1. Introduction: The Owyhee Field Office of the Boise District, Bureau of Land Management (BLM) is acquiring vegetation management services to slash and girdle juniper trees by hand.

2. Background: This treatment is part of the Pole Creek Project which will treat over a ten year period approximately 5,500-7,700 acres with slashing, girdling and broadcast burns. In combination with a grazing decision implementing changes to livestock management the two decisions will further improve upland and riparian conditions, moving the area much closer to reference conditions impaired due to juniper encroachment.

3. Purpose: Pole Creek #15-1, 15-2, 15-3. The objective of this treatment is to control encroaching western juniper into sagebrush-steppe by slashing and girdling western juniper trees within the project boundary. Slashed and girdled trees will then be jackpot burned during cool and moist conditions as not to burn surrounding vegetation.

4. Scope of Work.

Pole Creek #15-1, 1,390 Acres. Slashing, Girdling. Contractor will be required to either slash or girdle western juniper trees within the project boundary. The Contractor will furnish all tools, labor, supervision, equipment, materials, supplies, transportation, training and incidentals necessary to accomplish the task in accordance with the specifications provided.

Pole Creek #15-2, 1,180 Acres. Slashing, Girdling. Contractor will be required to either slash or girdle western juniper trees within the project boundary. The Contractor will furnish all tools, labor, supervision, equipment, materials, supplies, transportation, training and incidentals necessary to accomplish the task in accordance with the specifications provided.

Pole Creek #15-3, 1,293 Acres. Slashing, Girdling. Contractor will be required to either slash or girdle western juniper trees within the project boundary. The Contractor will furnish all tools, labor, supervision, equipment, materials, supplies, transportation, training and incidentals necessary to accomplish the task in accordance with the specifications provided.

5. Location of Treatment Areas:

Pole Creek #15-1, 15-2, 15-3. All units are located in southwest Owyhee County, 36 miles south of Jordan Valley. Oregon. Access is off of the Owyhee Backcountry Byway (Mud Flat Road) and the junction of the Payne Ranch. The ranch provides access to a two track road that leads 6.5 miles to the southwest and then 7 miles to the southeast and into the project site. All three units are located adjacent to each other. Project site location is considered remote. Please refer to attached project map for further detail. (Attachment 1,3,4)

6. Project Boundary Marking: The location and access to the areas are shown on the project maps. The project area is identifiable by flagging, roads, streams and fences as shown on the attached project map.

7. Vehicle Access and Use: 4x4 equipped vehicles are strongly recommended to access the project site. Both access roads into the project site can be considered primitive 2 track roads for at least 3-5 miles. Travel times from maintained roads to the unit can be considered very slow for automobile traffic. Pickups and larger vehicles associated with cutting treatments and as well as support vehicles will be restricted to established roads and trails.

Rubber tire ATVs may travel off-road to access the trees. ATV use may be restricted where needed to protect sensitive plant populations and cultural resources.

Undercarriages of all vehicles will be cleaned before entering the treatment areas to avoid spreading noxious weeds.

If roads or any type of access become impassable or subject to damage, because of adverse weather conditions or other natural and/ or social reasons, the COR will relay information to the Contractor, and a Stop Work Order may be implemented by the CO until other access can be obtained.

8. Notification of Cessation or Restart of Work: The Contractor will notify the Contracting Officer's Representative (COR) at least 3 days before they plan to start operations. Contractor will also notify the COR whenever he intends to cease operations for one or more days and will tell the COR at that time when they plan to resume operations.

9. Personnel/Equipment Requirements: The Contractor must maintain an adequate work force at all times to ensure timely completion of the work, and is responsible for the crew knowing the requirements of the contract. The crew is also responsible for maintaining a safe working environment following OSHA standards. The Contractor must attend the pre-work meeting and provide a written performance plan, including crew size, prior to beginning work.

10. Contractors Representative: One Contractor Representative (foreman) must be designated by the Contractor. A Contractor Representative must be on-site directing work at all times. This person must be fluent in English and will serve as an on the ground contact person for the COR/PI. Failure to maintain a Contractor Representative will result in suspension of work until an acceptable on-the-ground Contractor Representative is provided. A maximum of five (5) days will be allowed to produce a qualified Contractor Representative. Failure to do so within five days may result in the Contracting Officer (CO) issuing a Suspend Work Order. CO and COR must be informed of any changes of Contractor Representative.

11. Camping: Camping on agency-administered lands will only be allowed in approved sites. The Contractor shall maintain all camping areas in an orderly and sanitary manner. All fire regulations and restrictions shall be followed. All garbage and refuse shall be removed from the camp site(s) by the Contractor and disposed of offsite before final payment is made.

12. Detailed Unit Information: The western access route to the unit crosses private land and access will be secured by the BLM prior to the award of this contract if necessary. The unit is considered very remote with no cellular phone service on site, 36 miles to the closest services (gas/motel). Travel time between Jordan Valley and project site is estimated at 1.5 hours depending on vehicles and speeds.

13. Specifications for Treatment: Pole Creek, Unit 15-1, 1,390 acres SLASHING/GIRDLING

SLASHING: The slashing in Pole Creek Unit 15-1 is characterized by two slashing difficulties.

430 acres, Slashing Item 0001AB-Level II-Unit density of material to be severed is estimated to average between 21 and 40 percent of total cover.

960 acres, Slashing Item 0001AC-Level III-Unit density of material to be severed is estimated to average between 41 and 60 percent of cover.

Cutting Specifications: These cutting specifications apply to all levels of slashing difficulty.

SLASHING

(a) All juniper from 0in - 8 in. DBH will be severed at the stump and will be left on site.

(b) Any and all trees to be slashed shall be completely severed, and the remaining stump height shall be within (6) in. from the ground on the uphill side.

(c) No live branches will remain on the stump of any juniper tree after the tree is slashed.

GIRDLING: The girdling in Pole Creek Unit 15-1 is characterized by two girdling difficulties.

(c) All live limbs will be cut below the girdling cuts.

GIRDLING

RESTRICTIONS

(a) Old growth juniper will not be cut down. Old growth trees are identified by their rounded, flat, or irregularly shaped canopies as opposed to seral trees which are easily distinguished by their conical (Christmas tree) appearance. Additional indicators of old growth trees include deeply furrowed, fibrous, and reddish bark; presence of lichens; and large branches near the base of the trunk.

(b) Slashing and girdling will not occur to any tree containing a raptor nest (including large cavities suitable for nesting).

(c) Slashing and girdling will not occur to any tree that is part of a fence line or that can’t be slashed or girdled without damaging the fenceline.

14. Special Provisions:

The contractor shall conduct all operations permitted under this contract in accordance with the Idaho Forestry Act Fire Hazard Reduction Law and Rules and Regulations Pertaining to Forest Fire Protection and Fire Hazard Reduction (1992). Primarily for purposes of fire prevention and control, the Contractor shall comply with the following provisions during closed fire season or periods of fire danger:

The contractor shall:

(a) Any person using a portable power saw on range or forest land in the state shall have the following immediately available for the prevention and suppression of fire within fifty (50) feet of any power saw when in operation.

(b) A fully charged operable fire extinguisher of at least 8 oz. minimum capability. Such fire extinguisher shall be filled and in effective operating condition and shall at all times be immediately available to the operator when the saw is being fueled or the motor of the saw is running. A size O or larger shovel shall be available with each gas can when refueling. Any fueling of a power saw shall be done in an area which has first been cleared of all flammable material. Power saws shall be moved at least twenty (20) feet from the place of fueling before the engine is started.

(c) Portable power saws shall be equipped with properly installed, maintained and effectively working spark arresters as designated in the Rules and Regulations pertaining to Forest Fire Protection, Idaho Department of Lands (1992).

(d) Comply with all applicable State and Federal laws and regulations pertaining to water quality in connection with any operations under this contract.

(e) Take every reasonable precaution not to pollute or obstruct any stream, lake or reservoir on or near the project area in connection with any operations under this contract. If contractor’s operations cause pollution or obstruction of any stream, lake or reservoir on or near the designated cutting area, contractor shall notify the authorized officer immediately, and will correct the condition to the satisfaction of the

BLM.

15. Protection of Improvements: The COR may order a cessation of work if vehicles are operated on roads within the work area when ground or weather conditions cause or lead to loss of traction or rutting. Such conditions usually develop where frozen ground is thawing, when snow is melting, and during or immediately following rainstorms.

Ground disturbance will be reduced by tracking over an area one time, and then avoiding sharp tight turns that cause the soil and vegetation to be turned up. Any soil and ground disturbance caused by equipment during and after operations will be rehabilitated.

16. Salvage Rights: The Contractor does not have salvage rights to the trees.

INSPECTION AND ACCEPTANCE

Inspection: The Government COR and/or PI will make periodic visual inspections. Inspection will consist of documentation of the treated areas. Documentation will be based upon compliance with the specifications listed above.

COR and/or PI will discuss all deviations from specifications with Crew Representative as soon as possible when deviations from specifications are found. If disagreements occur between the COR and the Contractor on inspection, an agreed upon plot inspection will be initiated.

Acceptance: Acceptance will be based upon 95% visual compliance with the specifications listed above.

SITE VISIT

Perspective bidders are urged to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. 3. 52.232-99 PROVIDING ACCELERATED PAYMENT TO SMALL BUSINESS

SUBCONTRACTORS (DEVIATION)

AUG 2012

This clause implements the temporary policy provided by OMB Policy Memorandum M-12-16, Providing Prompt Payment to Small Business Subcontractors, dated July 11, 2012.

(a) Upon receipt of accelerated payments from the Government, the contractor is required to make accelerated payments to small business subcontractors to the maximum extent practicable after receipt of a proper invoice and all proper documentation from the small business subcontractor.

(b) Include the substance of this clause, including this paragraph (b), in all subcontracts with small business concerns.

(c) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act.

4. 1452.228-70 LIABILITY INSURANCE -DEPARTMENT OF THE INTERIOR JUL 1996

(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:

TYPE OF INSURANCE COVERAGE

Automobile Liability $200,000 per person, $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage.

Comprehensive General $500,000.00 per occurrence on the comprehensive Liability

Workman's Compensation Contractor shall comply with applicable and employers Liability Federal and State Workers' compensation and occupational disease statutes. Employer’s liability coverage of at least $100,000 is required except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers. (Other as Required by State and/or Federal Law)

THIS MANDATORY INSURANCE PROVISION SHALL FLOW DOWN TO ALL SUBCONTRACTORS

(b) Each policy shall have a certificate evidencing the insurance coverage. The insurance company shall provide an endorsement to notify the Contracting Officer 30 days prior to the effective date of cancellation or termination of the policy or certificate; or modification of the policy or certificate which may adversely affect the interest of the Government in such insurance. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy number and brief description of contract services to be performed. The contractor shall furnish the Contracting Officer with a copy of an acceptable insurance certificate prior to beginning the work.

SECTION 3

CONTRACT ADMINISTRATION DATA

2. CONTRACTING OFFICER'S REPRESENTATIVE (COR) AND/OR PROJECT INSPECTOR (PI)

The COR and/or Project Inspector (PI) will be appointed by the Contracting Officer upon award of the contract. Such COR/PI will be responsible for giving the Contractor any special instructions or guidance necessary to complete delivery as required by the contract. The COR or PI does not have the authority to modify or in any way amend the terms of this contract.

3. ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS - INVOICE PROCESSING

PLATFORM (IPP) (SEPTEMBER 2011)

Payment requests must be submitted electronically through the U.S. Department of the Treasury's Internet Payment Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions- Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

(a) Copy of Company Generated Invoice.

The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in CCR) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

4. AUTHORITIES AND DELEGATIONS SEP 2011

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries.

Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.

The Contractor need not proceed with direction that it considers to have been issued without proper authority. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

SPECIAL CONTRACT REQUIREMENTS

1. 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK APR 1984

The Contractor shall be required to (a) commence work under this contract within 5 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 62 calendar days after receipt of Notice to Proceed. The time stated for completion shall include final cleanup of the premises.

2. SIMULTANEOUS PERFORMANCE

If a Contractor receives award of more than one contract, simultaneous performance will be required. All work must be completed within the timeframe allowed for each contract.

3. BLM - VARIATION IN QUANTITY (SERVICES) (DEVIATION)

If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 20 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 120 percent or below 80 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified.

4. WORK HOURS

Work hours under this contract shall be limited to the time between one-half hour before sunrise to one-half hour after sunset each day. No work will be done on Saturday, Sunday, or legal National Holidays or Federal Holidays unless authorized by the COR.

National and Federal Holidays to be observed are:

The Contractor shall observe any other day designated by Federal statute, Executive Order or the Presidential proclamation.

When any such day falls on a Saturday, the preceding Friday is observed; when any such day falls on a Sunday, the following Monday is observed. All personnel assigned to perform under this contract shall limit their observation of holidays to those set forth above.

5. FIRE PREVENTION AND LIABILITY
