STATEMENT OF WORK
1.0 BACKGROUND
This contract is intended to procure quality hay products for the feeding of wild horses and burros at the National
Wild Horse and Burro Center at Elm Creek in Elm Creek, NE. The National Wild Horse and Burro program is an integral part of the management of federal lands in the western United States. Every year wild horses that are determined to be excess on the public lands are removed and placed in the Adopt-A-Horse program. This program places wild horses and burros into private homes around the country. The Wild Horse and Burro Center at Elm Creek (EC) is charged with taking care of these animals on their journey to private adopted homes. A good feeding program is an integral part to the care the animals receive while on the facility.
2.0 GENERAL REQUIREMENTS
The purchase of good quality alfalfa hay helps ensure the good care of wild horses on the facility. The contract will ensure the procurement of good quality hay for the feeding of 400-500 wild horses and burros per day throughout the year. This will require the delivery of hay to feed up to 6.5 tons of hay per day or 195 tons per month (which includes an estimated 700 small square bales, per month) throughout the year. The Hay Contractor shall coordinate all deliveries with the Bureau of Land Management’s (BLM) Contracting Officer’s
Representative (COR), and the EC Feeding contractor. The Hay Contractor will unload all the small square bales into the BLM hay shed and the EC Feeding Contractor will unload the loads of round bales with the feeding contractor’s provided on-site tractor. This is why the hay contractor must coordinate round bale load deliveries with the COR and EC Feeding Contractor.
3.0 SPECIFIC REQUIREMENTS
The primary, large volume feeding of alfalfa hay is through the use of large round bales. This will be the largest amount of hay needed to be supplied by the hay contractor. EC also feeds animals in the smaller load pens and sick pens using small square bales. It is estimated that BLM will need approximately 700 small square bales on a monthly basis. However, this quantity may vary from month to month depending on the number of animals being maintained in sick pens and the number of animals being unloaded at the facility.
a. Large Alfalfa Round-Bale Requirements
-Protein level 16% or higher
-Relative Feed Value 125 or higher
-Weed level less than 5%
-Grass level less than 5%
-Moisture content of less than 18%
-Hay test available upon request within 10 days of delivery
-Weigh ticket for each load to verify weight delivered
b. Small Alfalfa Square Bale Requirements
-Protein level 16% or higher
-Relative Feed Value 125 or higher
-Weed level less than 5%
-Grass level less than 5%
-Moisture content of less than 18%
-A bale should weigh between 65 pounds and 85 pounds
-Hay test available upon request within 10 days of delivery
-Weigh ticket for each load to verify weight delivered-Delivered/unloaded as directed by the COR
All hay delivered will be free of dust, mold and heating. All deliveries will be inspected by the on-site
COR/PI, and will be subject to their approval and acceptance, or rejection in the event of shipment of non-compliant hay before unloading. Deliveries will be during normal business hours, Monday-Friday 8 a.m-4 p.m., and coordinated with the COR and EC Feeding contractor. Weekend deliveries will only be allowed after approval by the COR and coordinated with the EC Feeding Contractor. Weigh tickets will be provided to the COR when the loads are delivered to the EC facility.
The estimated yearly amount of hay to be fed on the facility will be approximately 2,400 tons in a 12 month period. Approximate delivery schedule for the hay will be once a month but could be more frequent if the quantity of hay being consumed is greater or the numbers of animals being housed increases. Hay deliveries will be required in a timely manner and not drawn out except for extenuating circumstances which will require the prior approval by the on-site COR. Deliveries will need to be approximately on average 30 tons per day or within 5-7 working days.
(1) Approximately 700 small square bales will be required per month and can be stored in the shed provided by the BLM on-site.
(2) The remainder of the hay to be shipped and unloaded shall be the large round bales, as described above.
c. Special circumstances
Inclement weather in Nebraska is a common occurrence. It is the goal of the EC facility to maintain from month to month a backup supply of large round bales of hay to allow for periods of weather in the form of snow or muddy conditions which may conflict with a Hay Contractors ability to get hay out of a field for delivery to the EC facility. It is the goal of the EC facility to have 30-50 large round bales on-site at all times to maintain a 3-5 day feeding supply on-hand in cases of severe snow or mud conditions which would impact a contractors ability to retrieve hay from a field to deliver to the EC facility. Thus, it is anticipated that deliveries should begin as the supply of hay on the EC facility is at or about 30-50 large round bales. This will insure the facility has a backup supply of hay at all times in the case of delivery problems such as snow and mud conditions or any other unforeseen conflicts occur.

(a) A variation in the quantity of any item called for by this contract will not be accepted unless the variation has been caused by conditions of loading, shipping, or packing, or allowances in manufacturing process, and then only to the extent, if any, specified in paragraph (b) of this clause.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the
Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

52.222-99 ESTABLISHING A MINIMUM WAGE FOR CONTRACTORS (DEVIATION) (JUL
2014)
This clause implements Executive Order 13658, Establishing a Minimum Wage for Contractors, dated February 12, 2014, and OMB Policy Memorandum M-14-09, dated June 12, 2014.
(a) Each service employee, laborer, or mechanic employed in the United States (the 50 States and the District of
Columbia) in the performance of this contract by the prime Contractor or any subcontractor, regardless of any contractual relationship which may be alleged to exist between the Contractor and service employee, laborer, or mechanic, shall be paid not less than the applicable minimum wage under Executive Order 13658. The minimum wage required to be paid to each service employee, laborer, or mechanic performing work on this contract between January 1, 2015, and December
31, 2015, shall be $10.10 per hour.
(b) The Contractor shall adjust the minimum wage paid under this contract each time the Secretary of Labor’s annual determination of the applicable minimum wage under section 2(a)(ii) of Executive Order 13658 results in a higher minimum wage. Adjustments to the Executive Order minimum wage under section 2(a)(ii) of Executive Order 13658 will be effective for all service employees, laborers, or mechanics subject to the Executive Order beginning January 1 of the following year. The Secretary of Labor will publish annual determinations in the Federal Register no later than 90 days before such new wage is to take effect. The Secretary will also publish the applicable minimum wage on www.wdol.gov
(or any successor website). The applicable published minimum wage is incorporated by reference into this contract.
(c) The Contracting Officer will adjust the contract price or contract unit price under this clause only for the increase in labor costs resulting from the annual inflation increases in the Executive Order 13658 minimum wage beginning on
January 1, 2016. The Contracting Officer shall consider documentation as to the specific costs and workers impacted in determining the amount of the adjustment.
(d) The Contracting Officer will not adjust the contract price under this clause for any costs other than those identified in paragraph (c) of this clause, and will not provide price adjustments under this clause that result in duplicate price adjustments with the respective clause of this contract implementing the Service Contract Labor Standards statute
(formerly known as the Service Contract Act) or the Wage Rate Requirements (Construction) statute (formerly known as the Davis Bacon Act).
(e) The Contractor shall include the substance of this clause, including this paragraph (e) in all subcontracts.
1452.201-70 AUTHORITIES AND DELEGATIONS (SEP 2011)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting
Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting
Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause.
A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the
Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.
52.252-6 AUTHORIZED DEVIATIONS IN CLAUSES (APR 1984)
(a) The use in this solicitation or contract of any Federal Acquisition Regulation (48 CFR Chapter 1) clause with an authorized deviation is indicated by the addition of “(DEVIATION)” after the date of the clause.
ORDERING PROCEDURES
Performance under this contract shall be subject to the following ordering procedure:
a. The Contractor shall incur costs under this contract only in the performance of Task Orders and modifications to
Task Orders issued in accordance with this ordering procedure. No other costs are authorized without the express prior written consent of the Contracting Officer.
b. From time to time during the term of this contract, unilateral task orders will be issued orally by the Contracting
Officer’s Representative, designating the amount of hay to be delivered and required delivery dates, at the contracted prices. Such orders will be issued not in excess of the appropriated contract funding.
ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS – INTERNET PAYMENT
PLATFORM (IPP) (APR 2013)
Payment requests must be submitted electronically through the U. S. Department of the Treasury’s Invoice Processing
Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice [CO to edit and include the documentation required under this contract]: A copy of the contractor’s invoice, to include a description of the line items being billed, the unit prices for each line item and the total amount for each line item, along with the total amount of the invoice.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The
Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 – 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(A) Adequacy of offeror's demonstrated past performance in similar contracts or projects for federal agencies and/or private organizations in terms of price control, quality of work and compliance with performance schedules. Offeror shall identify agencies/firms for which similar supplies were provided within the past two (2) years. Failure of the offeror to submit its past performance information shall not be a cause for rejection of the proposal nor shall it be reflected in the Government's evaluation of the offeror's past performance. In addition to responses received the Government reserves the right to consider information obtained from any other sources when evaluating the offeror’s past performance.
2. Price
This factor evaluates the reasonableness and, as necessary, the price realism, of proposed prices. The Price factor is not numerically weighted or scored. The realism of proposed prices may significantly affect the final selection for award.
Material unbalancing between line items may be cause for rejection of the offeror’s proposal.
Past Performance is considered equal in importance to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(a) Definitions. As used in this provision--

If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan
Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;

“Service-disabled veteran-owned small business concern”—
