Nature and/or Description of the Action Being Processed:

This is a one-time Firm Fixed Price request for Other Than Full and Open Competition for brand name-only procurement for Stryker System 9, Stryker TPX, and Stryker CD Drill Systems. The instruments will be used in Orthopedics, Podiatry, and ENT and Neurosurgery.

The estimated value to the government is $ Delivery must be within 90 days of purchase order processing and order placement.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement.

Competition is restricted on this procurement for the reasons below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Accordingly, TrillaMed LLC, Beacon Point LLC and Veterans Helathcare Supply Solutions are the only firms capable of providing the supplies and services described above without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Souces sought posted on 10/13/2023 and VIP email sent out to 880 verified and certified SDVOSBs/VOSBs. NAC, Google Website, GSA, DSBS and FPDS.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Government will award a Firm-Fixed Price contract to the responsible quoter using a comparative evaluation of the SDVOSB authorized Stryker distributors. The comparative evaluation will be performed in accordance with FAR 13.106-2(b)(3). Once one quotation is found acceptable, it is compared to the remaining ones, and the “best” one is chosen for the best value to the government.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Market research findings:

Sources sought posted on SAM.gov produced three responses from SDVOSBs: TrillaMed, Veterans Healthcare Supply Solutions, and Beacon Point Associates LLC. Trillamed, VHSS, and Beacon Point Associates LLC also responded to the VIP sources sought sent via email. These vendors stated that they are authorized distributors and can support the needs of James A. Haley.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

This request is for brand name-only procurement. There are authorized Service-Disabled Veteran Owned Small (SDVOSB’s) capable of supporting the needs of James A. Haley. Trillamed, Beacon Point and Veterans Healthcare Supply Solutions.
