SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS IN

ACCORDANCE WITH FAR 13.5

1. Contracting Activity: Department of Veterans Affairs, Veterans Health Administration (VHA), Network Contracting Office (NCO) 16, supporting the Central Arkansas Veterans Healthcare System (CAVHS) located in Little Rock, Arkansas.

2. Nature and/or Description of the Action Being Processed: The Contracting Activity intends to negotiate and award a non-competitive (sole-source), firm fixed price, non-personal services contract with Veterans Tactical Solutions LLC doing business as (dba) VTS-Security LLC, a verified Service Disabled Veteran-Owned Small Business (SDVOSB) to provide unarmed security guard services required on behalf of CAVHS. The anticipated period of performance for the awarded contract is 02/03/2024 – 08/02/2024. The estimated total amount of this contract is $658,905.00.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The Government requires contractor support to provide uniformed and unarmed Security Guard services for the CAVHS medical facilities and outlining clinics to ensure safety for all CAVHS operations, staff, visitors, and patients. Basic duties include but not limited to:

manning static posts, conducting I.D. checks, performing traffic control and foot patrols, detecting and preventing and reporting safety incidents, and de-escalating disruptive patient and/or visitor behavior.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

( ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements ( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services ( ) International Agreement

(X) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above:

Authorized by Statute – See Veteran Affairs Acquisition Regulation (VAAR) 806.302-5 “Authorized or required by statute” and VAAR “806.302-570 Noncompetitive procedures for certified Veteran-owned small businesses.

(DEVIATION) dated 02/16/2023. VAAR 806.302-570(c) Sole source awards above the simplified acquisition threshold. (Citation: 41 U.S.C. 3304(a)(5), as authorized by 38 U.S.C. 8127(c)). The CO hereby determines the statute authority referenced above is in the best interest of the Government at this time.

VAAR 819.7008(c) states explicitly “A determination that only one SDVOSB can meet the requirement is not required,” and that using this authority, the following must be verified:

(1) The anticipated award price of the contract (including options) will not exceed $5 million--(the estimated value of the proposed action is $658,905.00)

(2) The requirement is synopsized and the required justification pursuant to FAR 6.302-5(c)(2)(ii) is posted in accordance with FAR Part 5--(The J&A will be posted on SAM).

(3) The SDVOSB concern has been determined to be responsible with respect to performance—( VTS-Security LLC, a verified Service Disabled Veteran-Owned Small Business (SDVOSB), is registered in the System for Award Management (SAM) as a SDVOSB under the applicable North American Industry Classification System (NAICS) code 561612 - Security Guard and Patrol Services, and listed and certified within the SBA certification database (VetCert).

VTS-Security LLC has successfully performed and currently provides these services to the VA, demonstrating that they have the expertise and experience required for successful performance. Veterans Tactical Solutions LLC doing business as (dba) VTS-Security LLC has been determined to be responsible contractor in accordance with (IAW) FAR Part 9.

Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: VAAR 819.7008(b) “The contracting officer's determination to make a sole source award is a business decision wholly within the discretion of the contracting officer.” VAAR 819.7008(c) “A determination that only one SDVOSB can meet the requirement is not required.”

he agency will make publicly available the justification required by FAR 6.305(a) within 14 days after contract award.

A follow on contract will be necessary upon expiration of this short term requirement, and the government anticipates to compete the future long term security guard services requirement.

Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: No award shall be made until the Contracting Officer determines the prices to the Government to be fair and reasonable. This determination will be based on proposed prices in comparison the Government’s IGCE and historical pricing data agreed to in one or more VA contracts for the same or similar services complemented.

Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted and Veterans Tactical Solutions LLC doing business as (dba) VTS-Security LLC has been determined to be responsible contractor in accordance with (IAW) FAR Part 9. The Government has completed a detailed review and assessment. The vendor is verified on the Veteran Small Business Certification (VetCert) database. The vendor has no active exclusions, nor are they listed as debarred, suspended or otherwise ineligible for award by any Federal agency. There are no findings indicative of contractor fault, compliance issues, terminations for cause, default or material failure to comply, or non-responsibility of the contractor.

Any Other Facts Supporting the Use of Other than Full and Open Competition: In accordance with Public Law 109-461, codified at 38 USC § 8127, in order to increase contracting opportunities for small business concerns owned and controlled by veterans and small business concerns owned and controlled by veterans with service-connected disabilities, contracting officers of the VA are given specific statutory authority to award a contract to a small business concern owned and controlled by veterans using procedures other than competitive procedures (i.e. a “sole source” contract). The contracting officer may do so in accordance with VAAR 819.7008.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: All future requirements will be handled on a case-by-case basis. A follow on contract will be necessary upon expiration of this short term requirement, and the government anticipates to compete the future long term security guard services requirement.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
