Version – November 2015 o Mar 2, 2016 USEUCOM J7 received notification that the Cubic Global Defense Inc., sole source plan was rejected by the contracting officer who opted for a full re-compete. This decision hinged on size / scope / duration of the contract. 19 TO’s were affected including the USEUCOM J7 requirement.

o SPAWAR informed USEUCOM J7 in April that the new SPAWAR MAC award date would be as late as , with TO completion delayed until as late as Mar 2017, this time did not include the execution of the DOCPERS process.

USEUCOM would lose their contractor’s workforce on 10 Sep 2016 and there would be a break in service.

o April-May 2016: The USEUCOM J7 has been researching other contracting agencies and options to include

None have been able to support due to timeline and German requirements (see below) or because the requirement falls outside their scope of work.

o June 2016: 409th CSB/TCC agrees to procure the analytical support for EUCOM.

The 409th’s strategy to procure the follow-on service is supported by this sole source bridge contract justification. The DOCPER office has indicated that 6 months should be planned for when coordinating a new “Note Verbale” review and approval for analytical work. Additionally, 9 months of procurement lead time from the June 2016 date substantiates the length of a one year bridge contract starting 10 September 2016. Procurement time of less than 9 months would inhibit the 409th’s capability to adequately compete the service while still continuing performance.

The proposed sole source contractor is Cubic Global Defense Inc., the current contract holder. The main limitations in using Cubic Global Defense Inc., are centered on working with DOCPER and the German Ministry of Foreign Affairs (MFA) timelines. Any new contract or company requires a new “Note Verbale” signed by the US Department of State and German MFA to be fully accredited/approved. DOCPER has stated full approval takes approximately 4-6 months from award date. Prior to this full approval, no new work can be conducted or new employees hired. For a bridge contract or follow-on/extension work, however, DOCPER can unilaterally approve existing work/”incumbents” to continue the work requirement. DOCPER requires notification through a Letter of Intent approximately 3 months prior to the contract start date, and the actual contract be awarded/in place approximately one month prior to start date. This process allows any incumbents (contractor personnel already hired and in place prior to the end of the current contract) to be approved for follow on work, even though the “Note Verbale” may not have been signed yet. This approval of incumbency requires the work to be at the same location(s), same job descriptions, and same statement of work. In addition, the hiring of any new personnel would result in a 4-6 month gap in service due to the DOCPER / German MFA limitations on not allowing new personnel hires or approvals until the full “Note Verbale” is signed. Only incumbent workers can be approved unilaterally by DOCPER to continue the existing work.
