Justification for Other than Full and Open Competition

Simplified Acquisition Threshold

1. Vessel: 270’ WMEC.

3. Description of Supplies or Services: purchase, Thirty-five (35) each Jacket Water Cooler Seal Kit, NSN: 2930-01-602-8570, P/N: 10-1AEW Seal, Purchase Cost $1250.50.

4. Estimated Value of Procurement: $43,750.00

6. Pursuant to FAR Subpart 13.106-1 (b), the Contracting Officer may solicit from one source if they determine that the circumstances of contract action deem only one source reasonably available:

7. Failure to maintain adequate stock to support field units would lead to loss of operational capabilities. These seal kits are use in the jacket water and lube oil heat exchangers (coolers) currently installed on the main diesel engines on board 270’ WMEC Cutters. These seal kits are part of the system that separates the jacket water from the sea water or jacket water from the lube oil. Any leakage between the systems would cause a catastrophic failure of the main diesel engine system.

The seal kits, conform to the exact form, fit and function with the currently installed coolers. Repair parts for these coolers are also supported on Allowance Parts lists (APL) 03075230A1, 2, 6, 03500240A1, 03247670A2 Cooler Fluid, Jacket Water & Lube Oil. A deviation from these coolers could cause additional cost to the government to re-engineer, dual stock, warehouse, and re-provision spare parts of a similar cooler.

8. The Manufactures drawings and specifications for these items are proprietary commercial property of the OEM; the Coast Guard has not purchased this information. The item conforms to exact design requirements for form fit function in order to mount and operate with the current system.

9. COTR will continue to conduct market research with a focus on locating vendors that are able to meet requirements, however without technical data described above obtaining full and open competition will be very difficult. The Coast Guard cannot require any vendor to release any vendor to release proprietary data.
