GENERAL SERVICES ADMINISTRATION

Public Buildings Service - National Capital Region Justification for Other than Full & Open Competition

Ongoing Commissioning and Meter Analysis at the Harvey W. Wiley Federal Building and GSA Federal Research Center (FRC) White Oak, Building 64

January 16, 2020

1. Nature and/or Description of the Item Being Approved

The GSA, NCR, PBS Acquisition Division in support of the Metropolitan Services Center at the Harvey W.

Wiley Federal Building in College Park, MD and GSA Federal Research Center (FRC) White Oak in Silver Spring, MD intends to award a new follow-on contract to Cimetrics, Inc. as a Sole Source firm fixed contract action for Ongoing Commissioning Services. The agency has determined that this procurement falls under 6.302-1 and 41 U.S.C. 253(c)(1) for "Only one responsible source and no other supplies or services will satisfy agency requirements." as the service and corresponding system is proprietary and highly specialized along with requiring expert level engineering personnel provided by Cimetrics, Inc.

2. Description of Supplies or Services Required The requirement is to provide Ongoing Commissioning Services at the Harvey W. Wiley Federal Building in College Park, Maryland and the GSA Federal Research Center (FRC) White Oak, Silver Spring, Maryland The intended award is to Cimetrics, Inc., 180 Lincoln Street Ste 3, Boston, MA 02111-2400. The contract is estimated to be $62,400.00 for services during the Base Year period of April 1, 2020 to March 31, 2021 with the ability to execute four (4) unilateral option years. The contract will also include 2 contract line items for optional tasks for the same service at GSA Federal Research Center (FRC) White Oak, Building 64. These optional tasks will not exceed 60 months exercised at the discretion of GSA. This will allow the Metropolitan Services Center to accomplish its mission of providing expert engineering building services that include, but are not limited to ongoing commissioning of the building automated system, retuning, remote monitoring, metering analytics, data polling, and data analysis through proprietary pre-approved GSA IT secured infrastructure.

3. Identification or Statutory Authority

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a) (1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

4. Demonstration that the Acquisition Requires Use of the Authority Cited Cimetrics, Inc. is uniquely qualified to provide these services based upon the following:

a. They have over ten years of analytical data of reviewing the daily HVAC operations and energy consumption at the Wiley Federal Building through its use of a proprietary BACNet data collection system that is also integrated with the proprietary Johnson Controls, Inc. (JCI) Metasys Building Automated System (BAS). The HVAC and energy data that is polled and collected includes, but is not limited to temperatures, air flows, pressures, metering, and other operating characteristics. Cimetrics then performs analytics on the data to improve HVAC and energy efficiencies and performance while utilizing high level JCI Network Integration Engine (NEI) and its interface with BACNet data collection protocol to read over 7,200 BAS points in the buildings control system. Through Cimetrics providing this service the Wiley building has a total of $995,362 of potential annual utility cost savings. Additionally, the recommended adjustments and repairs have realized $702,320 of annual savings. Also identified is a potential 4,133 Metric Tons of CO2 savings and of this potential 3,106 Metric Tons of CO2 savings have been realized and removed from the atmosphere.

b. They will play a critical role in facilitating the implementation of the GSA National Capital Region, Green Proving Ground pilot project through a participating company, Prescriptive Data, Inc. In order to ensure the successful implementation of this pilot program Cimetrics is currently and will be required to collaborate and share their data and analytics with the Prescriptive Data Nantum Operating System (Nantum OS) until the pilot project is completed. The Prescriptive Data Nantum OS is a proprietary system that identifies trends, analyzes data from several building systems (BAS, utility & power quality meters, and access control), factors in weather, and occupancy data sources to recommend real-time automated operational adjustments to improve building performance and tenant comfort. This pilot project is a no cost effort coordinated through the GSA Green Proving Ground. The extensive information that Cimetrics has and will need to provide is integral and otherwise unobtainable without Cimetrics.

c. Cimetrics, Inc. has extensive experience in meeting and maintaining GSA IT security hardening requirements and has done so successfully throughout their tenure. Their proprietary cache polling device collects and transmits BAS points data from the building to Cimetrics. The cache polling device has been scanned by GSA Central Office IT and found in compliance with GSA requirements. The extensive scanning process will be an extreme hurdle for any outside source that is unfamiliar with the constantly changing GSA IT Security hardening requirements. To repeat the scanning effort with another source will prevent the Metropolitan Service Center from successfully executing its mission and supporting its customer’s mission. There will be no guarantee that an outside source can successfully meet the security hardening requirements. The extensive time and effort invested by both the Government and Cimetrics to obtain a secure data collection process cannot be duplicated if Cimetrics is not the vendor for this service.

Furthermore, not having Cimetrics would cause a substantially unfavorable cost increase to the Government that would not be recovered through competition and create unacceptable delays and imminent deterioration in fulfilling the agency's requirements per 41 U.S.C. 253(d)(l)(B). Cimetrics, Inc. has intimate knowledge and expertise of the continued development of the highly specialized Ongoing Commissioning and Analytics.

5. Description of Efforts to Solicit as Many Offers as Practicable

No efforts to solicit will be taken. There are no other vendors that are able to provide these items.

6. Demonstration that the Anticipated Cost will be Fair and Reasonable In accordance with FAR 6.303-2(a)(7), the contracting officer determines by certifying this document that the anticipated contract cost for Ongoing Commissioning to the government of approximately $62,400.00 is considered to be fair and reasonable based on the attached associated independent government estimate.

7. Description of the Market Survey As previously stated, no additional market research was performed for this requirement. In accordance with the terms of FAR 6.302 Only One Responsible Source, Cimetrics, Inc. is the primary source for ongoing commissioning services at the Harvey W. Wiley Federal Building.

8. List any other facts supporting the use of other than full and open competition There are no additional facts or supporting information to support the use of other than full and open competition for this requirement.

9. List of Sources that Expressed Interest in the Acquisition No additional sources were contacted; therefore, no other sources could express interest in the acquisition.

10. Statement of Actions to Overcome Barriers to Competition The Government will continue to conduct market research to gauge the marketplace capabilities for future requirements in accordance with agency policy and the FAR. The Government will seek competition of future acquisition for these services if there exists sources capable of satisfying the Government’s requirements.
