Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

2. Brief Description of Services required and the intended use/Estimated Amount:

The proposed procurement is for monthly clean room surface viable sampling of pharmacy sterile compounding suites in Building 1 and 24 of the VA Central California HCS. The testing is to detect any microbial contamination and provide information on the environmental quality of the sterile compounding areas. The testing will help with the certification to ensure compliance with USP <797>, USP <800>, and The Joint Commission (TJC) standards for sterile compounding clean rooms.

This certification allows VA Central California HCS to produce IV and chemotherapy drugs as part of the patient care to the Veterans.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Current VHA directives require contractors to have a CETA-certified agent to conduct the testing;

however, it is up to the discretion of the contractor on whether or not the company keeps a CETA-certified employee. Furthermore, the testing must be compliant with existing USP 797, USP 800, and TJC standards. This in turn creates a very small field of potential vendors who can provide the required services under the required certifications and standards. As noted in the market research below, the Government has located only one responsible source capable of providing the required services: Technical Safety Services Inc.

4. Description of market research conducted and results or statement why it was not conducted:

Search through the VIP database under the applicable NAICS and PSC resulted in five VOSB/SDVOSBs; however, further investigation through the capabilities statements and websites revealed that none of the firms were capable of performing the services. Because the VA’s Rule of Two cannot be met, the Government does not anticipate pursuing this procurement as a VOSB or SDVOSB set-aside.

Searches through mandatory sources, AbilityOne and UNICOR, revealed that both sources cannot be utilized for this procurement. Similarly, searches through existing VA contracts revealed the same results. A search through GSA eLibrary revealed a multi-award schedule (MAS) under the NAICS category 541380 – Testing Laboratory Services. Under this MAS are 535 scheduled vendors.
