JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION USING

UNUSUAL AND COMPELLING URGENCY (FAR PART 13)

1.0 AGENCY/CONTRACTING ACTIVITY

National Aeronautics and Space Administration, John C. Stennis Space Center (SSC), Office of Procurement, Stennis Space Center, MS 39529

2.0 DESCRIPTION OF THE ACTION BEING APPROVED

The action being approved is for temporary custodial services in approximately 73 buildings where mission essential operations are continuing during the Novel Coronavirus Disease 2019 (COVID-19) emergency. It is anticipated that this procurement will be provided under a fixed price purchase order. The total estimated cost of this procurement is approximately Redacted.

3.0 DESCRIPTION

The work under this order will be for Mopping, dusting, disinfecting handrails, doorknobs, door handles, elevator buttons and access keypads for common areas and restrooms.

Contractor will utilize a combination of contractor provided products along with Government issued products.

4.0 STATUTORY AUTHORITY

This recommendation is made pursuant to FAR 13 for purchases using simplified acquisition procedures for commercial items along with FAR 6.302-2, Unusual and Compelling Urgency, under the authority at 10 U.S.C.2304(c)(2) or 41 U.S.C.3304(a)(2).

5.0 NATURE OF THE ACTION THAT REQUIRES USE OF THE AUTHORITY CITED

The President of the United States has declared a national emergency due to the spread of the corona virus (COVID-19). This virus has become a worldwide pandemic which has caused many countries, states, federal agencies, etc. to take drastic measure to curtail the spread. SSC has issued mandatory telework for non-mission essential personnel as of March 16, 2020. As of March 24, 2020, there are two (2) cases of COVID-19 on SSC which required the work addressed in this JOFOC to be worked. The need for expedited actions to get this work completed required the use of the unusual and compelling urgency authorization to be used.

6.0 SOLICITATION EFFORTS

No solicitation was posted to beta.sam.gov due to the urgency of this requirement. Division personnel researched via internet for local vendors capable of meeting the requirements of cleaning up. Multiple companies from that search were contacted via telephone. Many of these companies had the capabilities but did not have the availability.

7.0 CERTIFICATION

The anticipated price to the Government under this procurement action will be determined to be fair and reasonable.

8.0 MARKET RESEARCH

Division personnel researched via internet for local vendors capable of meeting the requirements of cleaning up. Multiple companies from that search were contacted via telephone. Many of these companies had the capabilities but did not have the availability.

9.0 OTHER SUPPORTING FACTS

As per the Proclamation on Declaring a National Emergency Concerning the Novel Coronavirus Disease (COVID-19) Outbreak dated March 13, 2020 from the President of the U.S., on March 11, 2020, the World Health Organization announced that the COVID-19 outbreak can be characterized as a pandemic, as the rates of infection continue to rise in many locations around the world and across the United States. The spread of COVID-19 within our Nation’s communities threatens to strain our Nation’s healthcare systems. Per the Center for Disease Control (CDC), as of March 25, 2020, 54,453 people from all States have been infected with the virus that causes COVID-19 and 737 have died.

10.0 SOURCES EXPRESSING AN INTEREST IN THIS PROCUREMENT

Redacted, Jan-Pro and Redacted all expressed interested, but only Jan-Pro had the immediate availability to meet SSC’s needs.

11.0 AGENCY ACTIONS TO REMOVE BARRIERS

SSC will maintain a list of interested parties for any future requirements, if needed, but due to the severity of this medical concern and the safety of all personnel, unusual and compelling urgency will likely be a continued authority to meet these requirements.

12.0 TECHNICAL REPRESENTATIVE CERTIFICATION

I do hereby certify that the support data under my cognizance that are included in this justification are accurate and complete to the best of my knowledge and belief. In addition, I certify that the anticipated price to the Government will be thoroughly evaluated to ensure that it is fair and reasonable prior to award.
