JUSTIFICATION FOR OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity

2. Nature/Description of Action
This action will result in a firm fixed price contract with P.K. Welding, LLC.
3. Description of Supplies/Services The supply being acquired for the Beltsville Agricultural Research Center (BARC) is the rental of a portable boiler for the 200 series buildings. The estimated value of this procurement is $ .
4. Statutory Authority In accordance with FAR 6.302-2 and 41 USC 3304(a)(2), the agency’s need for the portable boiler is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.
5. Demonstration of Contractor’s Unique Qualifications or Nature of the Acquisition that Requires use of the Authority Cited A fire occurred in a boiler plant, building 202, at the BARC on Monday, February 22, 2016. The fire damaged a mechanical room. The boilers in that structure provided heat to six buildings at BARC. It is imperative to get a temporary boiler in place as soon as possible to get heat returned to those six buildings.
6. FedBizOpps Announcement/Potential Sources
This sole source justification will be posted to FBO. Quotes were requested from three contractors.
7. Determination of Fair and Reasonable Cost
A fair and reasonable cost has been determined based on a review of the three quotes submitted.
8. Market Survey
Engineering staff at the BARC searched the internet for companies that can provide a portable boiler.
9. Additional Support

10. Other Interested Sources Quotes were sought from , , and P.K. Welding, LLC.
11. Actions Taken to Remove Barriers to Competition
N/A. This was an unforeseen accident that cannot be planned for.
