DEPARTMENT OF JUSTICE
FEDERAL BUREAU OF PRISONS
JUSTIFICATION FOR OTHER THAN FULL AND OPEIN
COMPETITION
Pursuant to Federal Acquisition Regulation (FAR) Part 6.302-1(a)(2), and the Bureau of Prisons Acquisition Policy (BPAP) Part 6.304(b), the Federal Bureau of Prison (BOP) has determined that the procurement for Joint Accreditation meets the criteria established for other than full and open competition. It is further determined that only one responsible source is available. The following is supporting documentation in accordance with FAR Subpart 6.303-2 Content.
1. Identification of the Agency and the Contracting activity: U.S. Department of Justice, Federal Bureau of Prisons, Central Office, Administration Division, Acquisition Branch, National Acquisition Section.
2. Nature and/or Description of action being approved: The BOP has a requirement for Joint Accreditation that allows the BOP Health Services Division to offer Continuing Professional Medical Education (CPME) credits/contact hours to licensed medical providers in the BOP.
3. Description of the Supplies/Services required to meet the agency’s needs including the estimated value: The Joint Accreditation (JA-ACCME) offers a single purchase that incorporates the Accreditation Council for Continuing Medical Education (ACCME), Accreditation Council for Pharmacy Education (ACPE), American Nurses Credentialing Center (ANCC), American Academy of PAs (AAPA), American Dental Association (ADA CERP), American Psychology Association (APA), American Social Work Board (AWSB), and the Commission on Dietetic Registration (CDR).
Joint Accreditation allows the BOP Health Services Division to offer CPME credits/contact hours to medically licensed providers in the following professional categories:
-Dentists -Allied Dental Staff (Dental Hygienist, Dental Assistant) -Registered Dieticians -Dietetic Technicians (Registered) -Nurses (Nurse Practitioner, RN, LPN, LVN) -Pharmacists -Pharmacy Technicians -Physicians -Physician Assistants -Psychologists -Social Workers
In the past, the BOP would pay each accreditation body (ACPE, AAPA, ADA, APA, ASWB, CDR) their annual fee separately; however, the fee is now combined to streamline the accreditation processes.
4. An identification of the statutory authority permitting other than full and open competition: Pursuant to the provision of 41 U.S.C. 253(c)(1), and FAR 6.302-1(a)(2), services required are available from only one responsible source and no other services will satisfy the agency requirements.
5. Determination that proposed Contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited: Joint Accreditation offers organizations the opportunity to be simultaneously accredited to provide continuing education activities for multiple professions through a single, unified application process, fee structure, and set of accreditation standards. JA-ACCME is the only organization to offer this benefit, allowing the Federal Bureau of Prisons the opportunity to offer the extensive range of continuing education accepted by our providers’ state licensing and professional boards.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practical, including whether a notice was or will be publicized as required by Subpart 5.2 and if not, which exception under 5.202 applies: The Notice of Intent to Award a Sole Source was publicized as required by Subpart 5.2 on sam.gov.
7. A determination by the Contracting Officer’s that anticipated cost to the Government will be fair and reasonable: No award shall be made until the Contracting Officer determines the cost to the Government to be fair and reasonable.
8. A description of the market research conducted: Market Research was conducted and it was determined that Joint Accreditation consisting of the three organizations, the Accreditation Council for Continuing Medical Education (ACCME), Accreditation Council for Pharmacy Education (ACPE) and the American Nurses Credentialing Center (ANCC) meets the Health Services’ requirements.
9. Any other facts supporting the use of other than full and open competition: There is no other option for a consolidated accreditation which would meet the requirements of our providers’ state licensing and professional boards.
10. A listing of sources, if any, that expressed in writing, an interest in the acquisition: The Accreditation Council for Continuing Medical Education (ACCME), Accreditation Council for Pharmacy Education (ACPE), American Nurses Credentialing Center (ANCC), American Academy of PAs (AAPA), American Dental Association (ADA CERP), American Psychology Association (APA), American Social Work Board
(AWSB), and the Commission on Dietetic Registration (CDR) are the only organizations that have combined their accreditation process.
11. A statement of actions, if any, that were taken to remove or overcome any barriers to competition: Health Services Division personnel continually review literature, periodicals, journals, computer magazines, vendor websites and newspapers seeking sources to promote full and open competition which will improve the way clinicians deliver medical care to the inmate population.
12. Technical Certification: I certify that the supporting data under my cognizance which are included in this Justification for Other Than Full and Open Competition are accurate and complete to the best of my knowledge and belief.
