JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
(JOFOC)
FAR SUBPART 6.3
I recommend the use of other than full and open competition for the acquisition of the following supplies or services. If this acquisition is to be made with only one source or a limited number of sources, negotiations will be conducted with the indicated proposed supplier(s).
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY:
Internal Revenue Service, Business Operations, Operations Branch, Western
2. NATURE/DESCRIPTION OF THE ACTION BEING APPROVED:
The objective of this solicitation is to establish a new, firm fixed price, contract to replace the existing contract 2091JB-19-C-00022, for Installation and Removal of Criminal Investigation’s (CI) radio and communications equipment program.
Contract will use FY20 funds with an Option Item to add additional FY21 funding if needed.
3. DESCRIPTION OF SUPPLIES OR SERVICES
The Internal Revenue Service, Criminal Investigation, needs to purchase services for installation, removal, and programming of all IRS-CI radio equipment; including mobile radios, base stations, repeaters and related peripheral equipment within the IRS-Criminal Investigation’s Secure Two- Way Motorola Radio System throughout the United States including Guam and Puerto Rico.
Period of Performance is 09/30/2020 thru 09/29/2021.

17. JUSTIFICATION (ADD PAGES IF NEEDED)
A. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR
THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED.
In order to accomplish the mission, the IRS-CI operates a nationwide two-way secure radio communications system. All CI radio equipment is made by Motorola. Motorola has a nationwide network of authorized service shops and trained employees. These shops are equipped with specialized tools and computer software required to properly install, remove, and program CI radio equipment. Only Motorola trained technicians with specialized tools and software can perform the maintenance work on these encryption modules. All IRS-CI radios contain proprietary firmware/software held by Motorola. Only certified Motorola service shops can perform maintenance and repair utilizing Motorola Radio Service Software (RSS).
B. DESCRIBE THE EFFORTS TAKEN TO ENSURE OFFERS WERE SOLICITED FROM AS MANY
POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR
WILL BE PUBLISHED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION
UNDER 5.202 APPLIES.
The proposed contract utilizes proprietary firmware/software. A notice with the JOFOC will be published on www.fbo.gov.
C. DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR
AND REASONABLE.
The Contracting Officer will ensure a fair and reasonable price for the Government.

The proposed contract involves the use of proprietary firmware and software. Market Research of the two way radio industry has confirmed that no other contractor can provide the required services.

In addition to surveying other federal law enforcement agencies to identify similar services provided by other vendors, the IRS will continue to seek out potential vendors who can provide the required services.
