Version 2.2 1 of 4
FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION | PROCUREMENT SECTION
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL
AND OPEN COMPETITION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304 (A) (1)
Date: February 11, 2021
Estimated Contract Dollar Value: $XXX,XXX.XX
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), National Acquisition Programs Unit (NAPU), has prepared this justification for other than full and open competition for five (5) Dual 77+ Pistol Grip Investigation Lasers on behalf of the Scientific and Biometrics Analysis Unit (SBAU), Laboratory Division (LAB).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
A one-time, sole source, firm-fixed price contract shall be awarded to Arrowhead Forensics, (Lenexa, KS) for five (5) Dual 77+ Pistol Grip Investigation Lasers. A Notice of Intent (NOI) to Sole Source will be posted on the beta.SAM.gov website for this requirement, which will publicize the FBI’s intent to issue an award to Arrowhead Forensics. This announcement will also give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of their technical capabilities and cost information for consideration prior to an award being issued.
3. A description of the supplies or services required to meet the agency’s needs.
This requirement is to provide five (5) Dual 77+ Pistol Grip Investigation Lasers at an estimated total cost of $XXX,XXX.XX. The Dual 77+ Pistol Grip Investigation Laser is a forensic light source capable of emitting light at 445nm and 520nm. It will be used by SABU to detect latent prints on submitted evidence. The laser operates at a wavelength of 445 nm or at 520 nm with a maximum radiant power of 10 watts (10W @ 445 nm; 8W @ 520 nm). The laser is lightweight and compact to enable users to carry it to various locations with the laboratory space for examination as necessary to meet operational needs. A powerful laser capable of producing light at the wavelengths and wattage above is a critical need for SBAU
Version 2.2 2 of 4 to ensure latent prints can be successfully detected on evidence and successfully captured in a digital image at a sufficient level of brightness and clarity.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
The Dual 77+ Pistol Grip Investigation Laser is only available from Arrowhead Forensics, and it is the only laser on the market that is capable of emitting the required wavelengths of light indicated below at the necessary wattage listed below.
The specific characteristics of the Dual 77+ Pistol Grip Investigation Laser that limit the availability to a sole source are as follows:
One Pistol Grip Handpiece Attachment Wavelength: 445 nm and 520 nm (selectable) Beam Quality: Uniform speckle free illumination Output Power: 10W @ 445nm; 8W @ 520 nm Touch screen to control output power 1W – 10W ‘Dead man finger’ (Press for output/release no output) Continuous on function for hands-free use 2 meter light guide Mains Voltage: 90-240V AC Frequency: 50 Hz / 60 Hz Power Consumption: 70W Maximum; 60W Typical Input Voltage: 12.6 VDC (Integrated Battery Pack) Two Batteris Included (Double Battery Life) Battery Lifetime: Approximately 14 hours continuous @ 445 nm, Approximately 7 hours continuous @ 520 nm, Lifetime: >10,000 hours Battery Life Indicator on LED Screen Ambient Temperature Range: 41-104oF (5-40oC) Humidity: 8-85%, non-condensing Dimensions: 8.5’ (L) x 4.5” (W) x 6.25” (H) Weight: 5.4 lbs.

Only the suggested source can furnish the requirements of the Dual 77+ Pistol Grip Investigation Laser, to the exclusion of other sources, because Arrowhead Forensics is the sole manufacturer and distributor.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated dollar value of this award shall not exceed $XXX,XXX.XX. Prior to issuing an award, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 13.106-3.
8. A description of the market research conducted and the results.
Significant market research was conducted through internet searches, attendance of forensic conferences, and forensic vendor literature review. Although there are other forensic “lasers” on the market, none can meet the required technical specifications listed above. A less powerful (lower wattage) laser would not be acceptable as it could potentially affect SBAU’s ability to detect and capture latent prints on item of evidence at a sufficient level of brightness and clarity.
9. Any other facts supporting the use of other than full and open competition.
Please see section three (3) and five (5) above.
10. A listing of any sources that expressed a written interest in the acquisition.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition if subsequent acquisitions are anticipated.
The actions of SBAU to identify potential sources possessing the ability to satisfy this and similar requirements are ongoing. The Government will continue to research the market to obtain as many available sources as required in accordance with the FAR to ensure that there are other vendors out there that can satisfy this requirement. In addition, the customer will do due diligence in ensuring that the barriers to competition are avoided to ensure we obtain the best value for the government.
