JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
FOR CCMS3 PROJECT MANAGER SUPPORT
1. Contracting Agency and Activity. The Federal Mediation and Conciliation Service (FMCS) plans to contract by means other than full and open competition. This document sets forth the justification and approval for award of a commercial contract as required by FAR subpart 13.5, and in accordance with 41 U.S.C.1901.
2. Nature of Action Being Approved. FMCS proposes to award a sole source contract to MERP Systems, Inc., located at 2201 Cooperative Way, Suite 600, Herndon, VA 20171, for project manager support of the Case and Contact Management System (CCMS3).
3. Description of Supplies or Services. FMCS has a requirement for project manager support to oversee and implement various modifications of CCMS3. The estimated dollar value of this award is . This includes a 6-month base period of and two (2) 3-month option periods at , respectively.
4. Statutory Authority. The statutory authority permitting the sole sourcing of these services is FAR 6.302-1(a)(2)(ii)(A), 10 USC 2304 (c)(1), which provides: “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Applicability of Authority: FMCS’s Case and Contact Management System (CCMS3) is a tailored application, customized specifically for FMCS. MERP Systems is the only vendor, other than the creator of the system, that possesses the intimate and unique knowledge and technical skills and abilities needed to oversee the implementation of modifications to the system. In addition, MERP Systems has experience managing the day-to-day activities of CCMS3, and they are currently ready to oversee and implement the required modifications.
6. Efforts to Obtain Competition: The Contracting Officer will post this requirement on SAM.gov for not less than seven (7) days and will consider quotes from other offerors if it is in the best interest of the Government.
7. Fair and Reasonable: The estimated priced proposed by MERP Systems are consistent with the hourly rates in their current contract, plus a 3% escalation rate, and will consequently be deemed fair and reasonable.

8. Market Research: Market research via the internet confirmed that MERP Systems is the only contractor capable of providing project manager support to CCMS3 as the system was customized specifically for FMCS.
9. Other Facts: Seeking out a different contractor to provide the required project manager support would cause a significant increase in cost to the Government as another contractor would need time to familiarize themselves with the system, the data located within the system, the modifications to be implemented, and FMCS IT operations. As such, this option would not be in the best interest of the Government.
10. Interested Sources: To date, no other sources have expressed an interest in this requirement.
11. Further Competition: FMCS will continue to perform market research to see what other options are available for this requirement. If it is determined to be in the best interest of the Government, FMCS will compete this requirement in six months rather than exercise Option Period 1.
