A JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Simplified Acquisitions
This document serves as the justification for obtaining limited competition, or no competition on the attached purchase which exceeded the micro-purchase threshold ($10,000.00). In accordance with FAR 6.001 (a), the traditional JOFOC format at FAR 6.303-2 is not applicable for purchases less than the simplified acquisition threshold.
The level of competition to be sought was determined after considering the factors listed at FAR 13.106-1(a):
1) The nature of the article or service to be purchased, and whether it is highly competitive and readily available in several makes or brands, or is relatively non-competitive;
2) An electronic commerce method that employs widespread electronic public notice is not available; and
3) The urgency of the proposed purchase;
4) The dollar value of the proposed purchase; and
5) Past experience concerning specific dealers’ prices.
In addition, the justification for this level of competition is made in accordance with FAR 13.106-1(b) which states: “For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from only one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.
urgency, exclusive licensing, industrial mobilization, etc.).” This acquisition is deemed:
Urgent
X Single Source
Other: This purchase is exempt from public notice per FAR 5.202(a)(2)
Comments: For continuity of medical care, it is in the best interest of FCI Gilmer to continue to utilize Interactive Medical Solutions for medical services. Any disruption of medical services would be detrimental to the operation of FCI Gilmer. A new solicitation has been posted and proposals from prospective vendors have been received. Currently, those proposals are being evaluated.
Before award, the contracting officer made a determination of fair and reasonable pricing in accordance with FAR 13.106-3 (a) (2) based on:
Market Research - FAR 13.106-3 (a) (2) (i)
XX Comparison of the proposed price with prices found reasonable on previous purchases - FAR 13.106-3 (a) (2) (ii)
Current pricelists, catalogs, or advertisements (see policy) - FAR 13.106-3 (a) (2) (iii)
A comparison with similar items in a related industry - FAR 13.106-3 (a) (2) (iv)
The contracting officer’s personal knowledge of the item being purchased. - FAR 13.106-3 (a) (2) (v)
Comparison to an independent Government Estimate. - FAR 13.106-3 (a) (2) (vi)
Other reasonable basis - FAR 13.106-3 (a) (2) (vii)
I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
