2. Nature/Description of Action being approved, i.e., sole source, limited competition, establishment of a :
Award will be on a limited source basis. The ATF SRT Canine Program currently has K9
Integrated Camera Systems that deploy on all SRT Canine operations. All of our Canine
Handlers and SRT Team Commanders are fully trained in their use and capability. The cameras have become a huge asset to our program since they were first put into use back in 2016. This purchase will ensure all Handlers have this vital piece of equipment. The purchase of five (5) K9
Storm Intruder Integrated Camera Systems and ten (10) K9 Storm Intruder Receivers, will allow all the Handlers and SRT Team Commanders to properly view Canine searches during our operations.
K9 Storm has no distributors or authorized resellers. They are a Sole Source vendor and they are the only company that can provide the required brand name equipment. This equipment is required for ATF SRT to meet its mission needs.

3. Description of Supplies/Services to include the period of performance and estimated value (including options):
ATF needs a specific type of Canine Camera and Receiver system to meet our needs. Only K9
Storm offers the below needed features that ensure camera stability, rapid deployment, and maximum barrier penetration. All ATF SRT Canines currently wear K9 Storm ballistic vests, and only the below K9 Storm camera will attach properly to this vest.
Five (5) K9 Storm Intruder Integrated Camera Systems for our SRT Canine Program. The camera system will come with the following:
30 Bit Encryption
K9 Storm Transmitter (operating time 35-40 minutes)
K9 Storm Slide Lock Rail System: K9 Storm’s Patent Pending Slide Lock Rail System enables the K9 Storm Intruder Camera to be slide locked into any Intruder Ready Vest in a few minutes in the dark with a gloved hand.
K9 Storm Handler Receiver (operating time 2.5-3 hours)
Monitor Pouch
Four K9 Storm Battery Magazines
Four Battery Charger Station
BNC Connector
Ten (10) K9 Storm Handler Receivers. 5 of these needed Receivers will be given to our five
SRT Team Commanders (TC’s). This will allow our TC’s to view the Canines in addition to the
Handlers. The remaining five will be given to Canine handlers in need of them to go along with their K9 Storm cameras.
Our Canines currently utilize K9 Storm vests during enforcement operations. Using the above
Slide Lock Rail System, we will be able to attach these cameras to our current canine vests. The
Intruder camera can typically be attached and removed in less than five minutes using this mounting system. The Slide Lock Rail System allows for a stable base, eliminating the need for bulky and cumbersome tie down straps. The K9 Storm camera gives us a constant and reliable signal, which is not the case with other Canine brand cameras we have used and tested.
Designed initially for military purposes, the Intruder has built in night-vision that transitions automatically depending on the light conditions. The Intruder is capable of transmitting roughly
1000 feet through multiple concreate barriers. It gives us the ability to conduct a building search and be a safe distance away from the dog, so that we can see what he sees but more importantly, how he is reacting to what he sees and smells. Additionally, our research has shown that he K9
Storm Intruder is the only canine camera capable of transmitting reliably through concrete and steel.

The Intruder is easy to operate as there are no menus or touch screens. Every aspect of the
Intruder can be operated in zero light conditions. The Intruder is also waterproof and meets IP67 standards. It is fully encrypted so the target, public, or media, are unable to pick up our video signal.

5. Demonstration of Contractor’s Unique Qualifications or Nature of the Acquisition that Requires use of Authority Cited:
The specific characteristics detailed above are what K9 Storm brand equipment provides that no other brand can offer. ATF has been using K9 Storm Cameras for our program since 2016, and they are the only authorized Cameras in use by our agency during enforcement operations.
Additionally, all of our Handlers and Team Commanders are fully trained on their use and capability, and the purchase of any other camera systems would be cost prohibitive and adversely affect mission readiness. ATF is a principal law enforcement agency within the United States
Department of Justice dedicated to protecting our communities from violent criminals who illegally traffic, possess, and use firearms, use explosives for criminal purposes, and engage in deadly acts of arson. In accordance with FAR 13.106-1(b)(1)(i) and (ii) - Only one source is reasonably available. Additionally, only one source is capable of providing the supplies or services required at the level of quality required, because the supplies or services are unique or highly specialized. K9 Storm has no distributors or authorized resellers. This procurement will be executed by awarding a Sole Source to K9 Storm, as only K9 Storm will satisfy the agency’s requirements.

6. Description of efforts made to ensure that offers were solicited from as many potential sources as practicable. Include whether or not a FBO announcement will be issued and attach a draft of the FBO notice. Include any exception under FAR
5.202. when not synopsizing. If any/similar requirements are anticipated in the future.
This approved Justification and Approval for Other than Full and Open Competition (JOFOC) will be posted in Beta.SAM.GOV showing our notice of intent to award a Firm Fixed Price (FFP), sole source purchase order in accordance with FAR 13.106-1(b)(1)(i) and (ii) to K9 Storm Inc.,168
Bannatyne Ave., Winnipeg, MB R3B 0R5, Canada, for K9 Storm (brand name) specialized canine protective equipment.
7. Determination by the Contracting Officer that the anticipated Dollar Value, including options demonstrates of fair and reasonable cost.
The anticipated dollar value of this purchase is estimated to be $180,985.
In accordance with FAR Part 13.106-3(a)(2)., proposed pricing from K9 Storm is deemed fair and reasonable. A comparison of the proposed price from previous purchases found it to be fair and reasonable. The Contracting Officer has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, re-training personnel, etc.) to meet the Government’s needs. SOD has discussed the attached quote with amongst our SME’s and we have also deemed the quote to be fair and reasonable.
8. Market Research:
Market research was conducted by ATF SOD. The results of this market research found that K9
Storm is the company that best meets our need. Due to this unique and specialized equipment, there are no other companies capable of meeting this need.
K9 Storm, Inc. has no negative findings for defective pricing or past performance listed in
CPARS. They are active in SAM and not on the excluded parties list.
We continue to stay engaged with all of our federal law enforcement partners as we share ideas and knowledge on related topics such as this. Additionally, our personnel attend annual law enforcement expositions and trade shows, such as National Tactical Officers Association and the
Shot Show. All of this information is gathered and analyzed by our personnel to help ensure we are procuring the best services for our agency.

11. Actions Taken to Remove Barriers to Competition:
ATF will continue to conduct market surveys and research through industry shows and technology releases in the form of papers and journals. This will be used to identify potential sources on subsequent acquisitions. If potential sources are identified, it will be necessary to submit to both extended compatibility and eventual validation studies, but due to the technical and specific nature of these courses, no other vendor has been found at this time.
