JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
(JOFOC)
For Joint Polar Satellite System (JPSS) Cross-track Infrared Sounder (CrIS)

1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”
This document is a justification for other than full and open competition prepared by National Aeronautics and Space Administration (NASA) Goddard Space Flight Center.
The procuring agency is the National Aeronautics and Space Administration (NASA) and the contracting activity is Goddard Space Flight Center.
2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:
This justification provides the rationale for contracting by other than full and open competition to award a new work modification to the Cross-Track Infrared Sounder Instrument (CrIS) Contract, NNG10XA06C with L3Harris for an increase in the post-delivery and post-launch support task order pool hours in accordance with Clause H.13
SPECIAL ENGINEERING SUPPORT AND POST-LAUNCH SUPPORT
REQUIREMENTS. The Suomi National Polar-orbiting Partnership (S-NPP) satellite was launched in 2011 and has greatly exceeded its anticipated mission life. This has required more task pool hours than originally anticipated. In addition, at the time of contract award it was not anticipated to store the CrIS instrument on the ground for an extended period of time. With the extended performance of S-NPP and the likely extended performance of NOAA-20, a need has arisen for extended post-delivery support for the long-term storage of the CrIS instrument for JPSS-3 and JPSS-4. In order to accomplish the post-launch and delivery support, it is necessary to add 21,000 hours to the task order pool.
3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the Agency’s needs (including the estimated value):
The NASA/JPSS program requires an addition of 21,000 hours to the 20,400 existing task order pool for a total of 41,400 hours.
The additional hours will allow L3Harris to continue to provide post-delivery support for the CrIS Suomi National Polar-orbiting Partnership (S-NPP), National Oceanic Atmospheric Administration (NOAA-20), and the planned addition of JPSS-2 instrument. These activities are within the general scope identified in Cross-Track Infrared Sounder (CrIS) Statement of Work (SOW) JPSS-2 (J2), document #472-00226. The estimated value of this addition is for 21,000 hours with an estimated cost increase of .
The period of performance of this contract is 18 months following the launch of JPSS-4.
4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
The rationale supporting the use of 10 U.S.C. 2304(c) (1) is only one responsible source and as described below:
L3Harris is the only responsible source as the design authority for the JPSS CrIS instrument and has successfully executed all previous efforts on contract NNGI0XA06C. In addition, L3Harris has designed, manufactured, integrated, tested, delivered, supported spacecraft integration, and supported on orbit support activities of the JPSS CrIS instruments. The effort proposed is a continued support activity and L3Harris has the unique knowledge, experience, personnel, and equipment needed to support this post-delivery support efforts.
The government has successfully worked with L3Harris to meet all the program commitments on the JPSS CrIS efforts. It is essential to the program success to maintain this capability.
6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
A notice to the Government Point of Entry (GPE) website (Sam.gov) was published on November 16, 2022, in accordance with FAR Subpart 5.2. This posting informed potential sources of NASA’s intent to award this sole-source modification to L3Harris Technologies, Inc. The results of this synopsis will be summarized in Section 10 below.
7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable.
The Government will evaluate the L3Harris proposal for the post launch support efforts. As part of the evaluation, the proposal facets of cost, schedule and proposed scope of work will be assessed, and a summary proposal evaluation will be documented. This information will be used by the proposal team to negotiate the contract change for the government.
8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:
Market research was not conducted because the Government seeks to procure the exact services from L3Harris as previously performed. Only L3Harris using its existing staff and facilities can support the post-launch support activities.
9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:
“None”
10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:
A notice of NASA’s intent to award this sole-source action was synopsized on the GPE website (Sam.gov) per FAR Subpart 5.2 (See Section 6 above). The Government posted a synopsis on November 16, 2022, with a response date of December 01, 2022. No interested parties submitted a response to the Government.
11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
The JPSS-1, JPSS-2, JPSS-3, and JPSS-4 contract efforts will continue to utilize the current contractor. Any future architectures will be open competitions. Additionally, the Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
