2. Nature/Description of Action being approved, i.e., sole source, limited competition, establishment of a new source, etc.:
This Brand Name Justification serves as the justification document approving the solicitation and purchase of Fire Scene Pro software for ATF’s Fire Programs and Training Branch (FPTB).
3. Description of Supplies/Services and estimated value, including options:
Background: ATF’s Certified Fire Investigators (CFI) utilize Fire Scene Pro software as a field diagramming tool for fire/arson scene documentation. Fire Scene Pro software is a simple to use platform with an expansive symbol library including more than 1,000 National Fire Protection Association standard fire specific symbols. Structures, streets, and symbols interact with one another. The software can leverage existing GIS services, and allows the user the benefit from/to scale imagery. Users can label, annotate, and diagram over the top of images, and digitally annotate diagrams with photographs, audio, and video. Pacific Architects and Engineers (PAE) was the sole source developer, manufacturer, and reseller of Fire Scene Pro software at that time.
In 2017, ATF purchased an additional 75 licenses of Fire Scene Pro software along with a three (3) year contract for software renewal and maintenance. That contract has now ended and FPTB would like to purchase a new three (3) year maintenance contract for 125
Control #: ATF________ ARQ #DJA-21-AFIA-PR-0795 Page 2 of 5 licenses of the software to include software updates (see attached SmartSafety Software/Trancite Logic Systems quote # 06142021.FS.PRO). This renewal of this maintenance and software updates is vital to the ATF CFIs ability to continue to meet their mission. In addition, by renewing the software that is currently in place, ATF will preserve and continue to develop the knowledge base already in place and will maintain the software system which supports evidence already in place.
PAE has now become SmartSafety Software/Trancite Logic Systems and is still the sole source developer, manufacturer, and reseller of the Fire Scene Pro software.
• Description of Requirement:

• Estimated Value: $83,572.50
• Period of Performance: All service license agreements must be delivered no later than three (3) days from award and licenses shall be good for one (1) year/365 days from issuance with a base year and four option years.

5. Demonstration of Contractor’s Unique Qualifications or Nature of the Acquisition that Requires use of Authority Cited:
Due to the specifications of this software, it is recommended to use the manufacturer’s brand of fire software, which is specifically made for fire investigation and documentation.
Using anything other than the manufacturer’s recommended software would potentially negate the ability of agents to properly investigate fires and place them at a grave disadvantage of their mission.
6. Description of efforts made to ensure that offers were solicited from as many potential sources as practicable.
This requirement will be posted to Beta. Sam/Federal Business Opportunities with the for fifteen days once this JOFOC has been approved with the intent to award a sole source.
7. Determination by the Contracting Officer that the anticipated Dollar Value, including options demonstrates of fair and reasonable cost:

The Contracting Office (CO) has determined that the stated price proposed by SmartSafety Software/Trancite Logic Systems is fair and reasonable. The current pricing submitted by vendor is reflective of the inflation for the current and future years that the software will be utilized. The pricing has not deviated from the current price of the software.

8. Market Research:
Market research via the internet and GSA for alternative products resulted in zero availability of similar products with key features necessary for the National Response Team’s mission. Based on market research, SmartSafety Software/Trancite Logic Systems is the only manufacturer and reseller that provides the software and maintenance.

11. Actions Taken to Remove or Overcome any Barriers to Competition:
The Bureau makes every effort to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The Acquisitions Branch will continue to utilize bidding websites as well as other competitive procedures to promote competition to the maximum extent practicable.
The Requesting Office will continue to research the marketplace and communicate with other agencies to determine if similar products and /or services can meet its needs in the future to remedy the restricted competition on future requirements of this technical nature.

In the future, competition will most likely depend on if the manufacturer allows other vendors to re-sell and maintain their equipment and related maintenance services.
