JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)

1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) Identification of the agency and
This document is a justification for other than full and open competition prepared by National Aeronautics and Space Administration (NASA) Glenn Research Center (GRC).
The procuring agency is NASA and the contracting activity is GRC.
2. FAR 6.303-2(b)(2) The nature and/or description of the action being approved:
This justification provides the rationale for contracting by other than full and open competition to award a sole-source contract 80GRC023Q0004 with Magna-Power Electronics, Inc. for the purchase of two (2) Magna-Power MTD700-357/480+ISO+LXI Power supplies.
The purpose of this procurement is to acquire two (2) 250,000W DC power supplies. The power supplies are identical to NASA Electronic Aircraf
NEAT is a test facility at Armstrong Test Facility (ATF) that allows the testing of high-power equipment for eventual use in hybrid-electric aircraft systems. It is one of the only facilities in the world that is able to test high-power systems and components under simulated altitude conditions. The NASA Electric Aircraft Testbed (NEAT) is currently using Magna- Power power supplies to power the testbed, and NASA is expanding its power capability to test high power components required for hybrid-electric flight. D-SITE is a sub-megawatt electrical powertrain test facility at the Armstrong Test Facility that is supporting electrified aircraft propulsion technology development. It is necessary to keep the same kind of power supplies so that they can be used with the existing power supplies and keep the stability between the power supplies.
NEAT is expanding its power capability in order to test high power components required for hybrid-electric flight. This procurement is for 2 (two) power supplies, which will enhance the existing capabilities between the D-SITE and NEAT facility. The total cost will be approximately $292,000.
3. FAR 6.303-2(b)(3) A description of the supplies or services required, to meet the
NEAT is currently using Magna-Power power supplies to power the testbed, and NASA is expanding the electric power of the facilities These additional power supplies will enable the testbed to conduct testing on higher power components required for hybrid-electric flight.
It is necessary to keep the same kind of power supplies so that they can be used with the existing power supplies purchased in 2019 and 2022. Use of another type of power supply unstable system that is unsafe for both personnel and hardware. The total cost will be approximately $292,000 with delivery expected approximately six (6) months after purchase.
Specifications

Must be compatible with existing Magna MT700 units in order to be used in master/slave configuration.
4. FAR 6.303-2(b)(4) An identification of the statutory authority permitting other than full and open competition:
The statutory authority permitting other than full and open competition is 10 U.S.C.
2304(c)(1), as implemented by FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements.
5. FAR 6.303-2(b)(5) qualifications or the nature of the acquisition requires use of the authority cited:
The rationale supporting the use of 10 U.S.C. 2304(c)(1) is the property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency; as described below:
This procurement is for additional units of a previous procurement because NASA must enhance the existing capabilities between the D-SITE and NEAT facility, and can only do so with the same power supplies that are currently being used.
Annual Performance Indicator (API) milestone, NASA must order these exact power supplies to be compatible with the units previously purchased. Only the identical power supplies are compatible with the current power supplies in the D-SITE and NEAT facilities.
6. FAR 6.303-2(b)(6) A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
A notice to the Government Point of Entry (GPE) website (Sam.gov) was published on August 31, 2023, in accordance with FAR Subpart 5.2. This posting informed potential a sole-source contract to Magna-Power Electronics, Inc.
The results of this synopsis are summarized in Section 10 below.
7. FAR 6.303-2(b)(7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
Officer has determined that the anticipated cost to the government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable.
This contract will be a firm fixed price for a commercial item. A similar procurement occurred in 2019 and 2022, so the quote will be compared to the historical price paid by the Government during this previous procurement. The quote will also be compared to similar items in the marketplace.
8. FAR 6.303-2(b)(8) Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:
In accordance with FAR 5.2, a description of this requirement was posted to the GPE website (Sam.gov) on August 31, 2023 and closed on September 15th, 2023. There were no responses.
9. FAR 6.303-2(b)(9) Any other facts supporting the use of other than full and open competition:
None.
10. FAR 6.303-2(b)(10) A listing of the sources, if any, that expressed an interest in writing in the acquisition:
-source action was synopsized on the GPE website (Sam.gov) per FAR Subpart 5.2 (See Section 6 above). A notice was published on August 31, 2023 for the required fifteen (15) days. 11. FAR 6.303-2(b)(11) A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
None. Any future power supplies for D-SITE and NEAT must be this same make and , and ensure the safety between the power supplies so there is not electrical bus instabilities.
