DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C248-21-AP-2485

1. Contracting Activity: Department of Veterans Affairs, VISN 08, Malcom Randall VAMC

2. Nature and/or Description of the Action Being Processed:

The North Florida/South Georgia Veterans Health System has a new requirement for the maintenance and repair of the Building Automation System (BAS) controls for the ORs.

Action will be awarded as a new, firm-fixed-price contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

Convert the ORs and associated spaces from pneumatic controls to DDC controls, install a room pressure monitor in the isolation room, change five (5) VAVs that currently have internal dampers and actuators to Siemens ZCU terminal units and install room temp and RH sensors in the areas listed above. Provide required points, alarms, trends and graphics on the Siemens Desigo CC Building Automation System.

• Convert the ORs and associated area VAV boxes and controls from pneumatic to DDC controls.

Areas involved are as follows: C286B-1-GV, C287-1 OR-A, C289-1 OR-B, C277-1 OR-C, C278-1 OR- D, E175-1 OR-E, E171-1 OR-F, E172-1 OR-G, E176-1 OR-H, E143-1 OR-I, E144-1 OR-J, C282-1 center core/scrub area, C286-1 Recovery area, E174-1 sub sterile, E176A-1 scrub area, E171A-1 scrub area, E173-1 sub sterile, E145-1 sub sterile, E147-1 sterile storage, E140A-1 day stay recovery, C280D-1 scrub area, E148-1 sterile storage, and C282E-1 storage.

• Install a room pressure monitor installed in C286B-1-GV, isolation room.

• Replace the VAVs in ORs D, G, H, J and C282-1 center core areas that have internal VAV actuators and cannot be repaired. Require these VAVs be replaced with new terminal units.

• Provide and install room Relative Humidity (RH) and temp sensors in E171-1, E170B-1, E169-1, E147-1, and E140A-1. No temp or RH sensors currently installed.

The estimated value of the proposed action is $362,920.00. The anticipated Period of Performance is 04/01/21 – 12/31/21.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The OR’s are Currently unable to control the temperature or air volume without physically entering the space which, presents added infection control concerns and disruption of the OR. The Siemens Building Automation and Control System is proprietary, and they are the only ones who can support the system with software and firmware upgrades. Controller panels will need to have firmware installed in them by Siemens. Points in the field panels will need to be addressed by trained Siemens technicians. Siemens technicians need to be used for all programming of the field panels. Require Siemens technicians to provide generation of required graphics, control and alarm points on the Siemens Desigo CC workstation front end. Require Siemens technicians to tune all PID control loops and verify proper operation of controls once programmed.

Additionally, Siemens is currently on site conducting an upgrade from Siemens Insight to Siemens Desigo for the entire campus Building Automation System. Currently have a multi-year service agreement with Siemens to assist in maintenance and repair of the BAS.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

A search of the VIP database revealed 2 SDVOSBs under NAICS 238220, using a keyword search of “Siemens”. However, the Siemens Desigo BAS is the new replacement for the Siemens Insight system.

Since it is such a new system, Siemens trained techs are the only ones capable of programming and initializing the new points required in the field panels for the OR area controls.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

Because of the proprietary nature of the services, any other vendor would ultimately have to subcontract a large amount of this work to Siemens Industry, Inc. As a result, a direct contract with Siemens will provide prices that are the best value to the government.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

A search of the VIP database revealed 2 SDVOSBs under NAICS 238220, using a keyword search of “Siemens”. However, the Siemens Desigo BAS is the new replacement for the Siemens Insight system.

Since it is such a new system, Siemens trained techs are the only ones capable of programming and initializing the new points required in the field panels for the OR area controls.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Siemens Industry, Inc. is currently on site conducting an upgrade from Siemens Insight to Siemens Desigo for the entire campus Building Automation System. Currently have a multi-year service agreement with Siemens to assist in maintenance and repair of the BAS.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

The market will continue to be monitored for new service providers that are trained on the Siemens Desigo CC BAS, both by the service and through the use of Sources Sought and industry engagement by the Contracting Officer.
