NATIONAL LABOR RELATIONS BOARD
JUSTIFICATION FOR OTHER AND FULL AND OPEN COMPETITION (JOFOC)
1. Identification of Agency and the contracting activity
National Labor Relation Board (NLRB), Office of the Chief Information Officer (OCIO), is to award a contract to One Diversified, LLC. This company has the unique position of being the contractor that originally installed and wired the NLRB system. Their knowledge of this requirement makes them uniquely positioned to complete this work timely and provide future maintenance assistance.
2. Nature and/or description of action being approved
It is recommended that the National Labor Relations Board use other than full and open competition for the acquisition of the supplies or services identified below.
Description of supplies or services The contractor shall provide, install, test, integrate, and make fully operational the Avigilon access control system using hardware and software products identified below and that are fully compliant with Homeland Security Presidential Directive (HSPD-12) and Federal Information Processing Standard Publication FIPS) 201 II.

- Furnish and install Avigilon CCTV head end to include:
- Network Video Recorders (NVR) – 96TB (NVR storage calculations are based on the cameras being configured at 15fps, 1080p resolution, RAID4 storage, 4 hours motion per day. If additional motion is anticipated, pricing will be revised to include additional storage to accommodate recording setting changes.)
· Cameras licenses for 34 CCTV cameras.
· Programming and Commissioning of CCTV system
· Testing of CCTV system for full functionality
· Training of End User Operator and Maintenance staff
· Turnover of CCTV system to End User staff M

The contactor shall also provide warranty technical support services on supplies, installation, integration, and operation of the newly updated and acquired hardware and software products; including furnish, installation, testing and make fully operational loaner, spare, and replacement parts.
All products, parts, services, and warranties shall be consistent with industry standards and original equipment manufacturer (OEM) guidelines. However, industry standards that do not void OEM warranty(ies) shall take precedence over non-industry standards and OEM guidelines.
The contractor shall demonstrate successful operational testing of all system devices installed or replaced on the operational security system.
The Contractor shall also provide telephone and onsite warranty and technical support shall be 24x7x365/6 on a per call basis.
3. Statutory Authority
FAR Subpart 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. (a) Authority. (1) Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1).
4. Contractor’s Unique Qualifications or Rationale for the Nature of the Acquisition Requiring Use of Authority Cited One Diversified, LLC is the only vendor that can provide all requirements listed in the SOW in the mandated time frame, because they are intimately familiar with the construction and wiring of the PACS security system and have security access already established at the NLRB.
5. Determination of Fair and Reasonable Pricing Pricing for the required services is approximately $95,000 and is discounted. Based on a review of similar requirements on GSA Schedule, this pricing is determined to be fair and reasonable.

I hereby certify that the above Justification for Other Than Full and Open Competition is accurate and complete to the best of my knowledge, information and belief, and hereby determine, based on the above findings, that NLRB’s minimum needs or schedule requirements or other rationale for other than full and open competition used to formulate a basis for this Justification are complete and accurate. In addition, I hereby certify that the determination to use this procurement method is the most advantageous way to fulfill NLRB’s need, that price and other considerations have been taken into effect, that sufficient funds are available, that the prices proposed are fair and reasonable and that therefore it is in the best interest of NLRB to award this Contract/Purchase Order on a Other Than Full and Open Competition basis, given that competition of this requirement is not feasible or practical at this time.
