JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY (JEFO)

1.

Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, is the contracting activity.

2.

The action submitted for approval is a JEFO for the acquisition of patient monitoring system hardware and software upgrades for the Fort Belvoir Community Hospital (FBCH).

3.

The requirement is available from Philips Medical Systems North America under contract SPM2D1-09-D-8349, which is valid through March 30, 2017. The total estimated dollar value of this action is $1,399,373.66. The patient monitoring system equipment hardware and software upgrades include two (2) Philips Intellivue Information Center (PIIC) iX , central monitoring systems, the server hardware for PIIC iX , twenty five (25) IntelliVue MX450 portable/bedside patient monitors, twenty four (24) IntelliVue MX800 bedside patient monitors, software upgrades to PIIC iX Release B and IntelliVue MP2, licenses and training.

4.

The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(B), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

The use of this authority is necessary because the PIIC iX patient monitoring system at FBCH currently uses the Windows XP Operating System (OS), which is no longer supported by Microsoft, and requires an upgrade to Windows 7 in order to meet associated Information Assurance (IA) requirements. This system is a fully integrated patient monitoring system which includes servers and network interface between patient bedside monitors (portable or mounted) that measure physiological parameters continuously and provide information to the central nursing station. Since the existing patient monitoring system at FBCH is proprietary to Philips Medical, the upgrade of the PIIC can only be accomplished by Philips Medical. In order for the bedsides to function with the PIIC iX (Windows 7) platform, FBCH requires an upgrade to a compatible version. FBCH will not be able to connect at the current software level FBCH is currently utilizing. This purchase will fulfill the DoD mandate to eliminate Windows XP systems and upgrade them with the Windows 7 certified operating systems.

5.

Philips patient monitoring system upgrades are available under DLA Troop Support Philips Medical contract SPM2D1-09-D-8349. The price was determined to be fair and reasonable based on comparison to Philips’ commercial prices August 17, 2016. The contracting officer has determined that the subject procurement represents the best value to the Government and results in the lowest overall cost alternative (considering price, special features, and administrative cost).

6.

Market research was conducted utilizing internet research, industry knowledge, and contact with competing vendors’ products and systems. DLA Troop Support continues to perform market research on the availability of patient monitoring systems and upgrades and the results of current market research indicate Philips Healthcare is the only known supplier of the hardware and software upgrades necessary for the patient monitoring system at FBCH.

7.

There are no other facts supporting the use of this JEFO.

8.

DLA will continuously conduct market research to identify any new sources for patient monitoring systems and upgrades.

9.
