JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY (JEFO)

(1) Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment

Division, is the contracting activity.

(2) The action submitted for approval is a JEFO for the acquisition of a Philips MRI scanner upgrade under Philips contract SPE2D1-17-D-0014 valid through December 2021.

(3) The required item is an upgrade for four (4) Philips Ingenia 3.0T MRI scanners at NMC San Diego.

The total estimated dollar value of this action is

(4) The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(b), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. The Philips MRI system upgrade identified above is the only product that can meet the customer’s needs.

This procurement is necessary to upgrade the existing four (4) Philips Ingenia 3.0T MRI scanners at NMC San Diego. The upgrade will significantly improve the capabilities of the existing systems as follows: the upgrade will enable Compressed Sensing (CS) capability, aide in scanning patients with MR Conditional implants, include Metal Artifact Reduction to aide in soft tissue visualization, and include updated reconstruction algorithm technology. It is not possible for a non-Philips party to make these substantial software and hardware changes to the existing Philips Ingenia 3.0T MRI scanners without nullifying the current Philips’ service agreement. Upgrading these systems will significantly reduce patient scan and image reconstruction times, enabling augmented MRI workflow and reducing patient anxiety.

(5) The Philips items required are available on the Philips radiology contract SPE2D1-17-D-0014. The contract pricing has previously been determined fair and reasonable via comparison with commercial pricing and other than cost or pricing data. The Contracting Officer determined that the subject procurement represents the best value to the Government.

(6) DLA Troop Support continues to perform market research on the availability of imaging systems and upgrades. The results of market research indicate that Philips is the only known supplier that can upgrade the current Philips Ingenia 3.0T MRI scanners and therefore meet the requirements of NMC San Diego. When the existing Philips Ingenia 3.0T MRI scanners reach their end of life, any future requirements for new MRI scanners will be competed.

(7) There are no other facts supporting the use of this JEFO.

(8) As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge.
