JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY (JEFO)
(1) Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment
Division, is the contracting activity.
(2) The action submitted for approval is a JEFO for the acquisition of a Philips cardiac catheterization system upgrade under Philips contract SPE2D1-17-D-0014, valid through December 2026.
(3) The required items are hardware and software upgrades with installation to the existing Philips cardiac catheterization system at Travis Air Force Base (AFB), California. The total estimated dollar value of this action is
(4) The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(b), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. Only Philips, the Original Equipment Manufacturer (OEM), can provide the necessary hardware and software items that are compatible with the existing Philips Allura X-ray system at Travis AFB. Hardware and software upgrades from sources other than Philips will not be compatible with Philips’ existing hardware and software.
Currently, the David Grant Medical Center is using a Philips Allura cardiac catheterization system, the Allura Xper FD20 BP. The proposed acquisition will upgrade the Allura Xper FD20 BP to the Philips AlluraClarity FD20 BP, with Intrasight 5 and Core IVUS Mobile. The AlluraClarity will bring improved image processing, noise reduction and reduced radiation exposure to clinicians and patients, while also increasing efficiency for exam room clinicians. The Intrasight 5 is the approved replacement for the CORE IVUS Cardiac that is no longer available. The Intrasight 5 provides improved physiology and imaging technologies and optimizes lab performance with efficient data management and user controls, remote service diagnostics, and advanced cybersecurity protection.
The CORE IVUS Mobile is required for improved visualization in vascular procedures. These upgrades will bring the existing equipment up to current technology standards and are essential to meet Travis AFB’s requirements.
(5) The Philips items required are available on the Philips radiology contract SPE2D1-17-D-0014. The contract pricing has previously been determined fair and reasonable via comparison with commercial pricing and other than cost or pricing data. The Contracting Officer determined that the subject procurement represents the best value to the Government.
(6) DLA Troop Support continues to perform market research on the availability of catheterization systems and upgrades. The results of market research indicate that Philips is the only known supplier that can upgrade the current Philips catheterization system and therefore meet the requirements of Travis AFB. No other companies’ similar products can meet Travis AFB’s needs.
When the Allura system at Travis AFB requires replacement, DLA anticipates the acquisition of a new system will be conducted on a full and open competition basis.
(7) There are no other facts supporting the use of this JEFO. No other items that will fulfill this requirement on the radiology contract are compatible with Philips’s existing system at this time.
(8) As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge.
