JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY (JEFO)

(1) Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment

Division, is the contracting activity.

(2) The action submitted for approval is a JEFO for the acquisition of an upgrade to a Hologic Selenia Dimension System under Hologic contract SPM2D1-09-D-8334 valid through February 2017.

(3) The required items are a Hologic Selenia Dimension System upgrade for the Naval Medical Center (NMC) Groton, CT. The total estimated dollar value of this action is $179,400.00

(4) The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(b), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. The upgrade to the Hologic Selenia Dimension System identified above are the only products that can meet the customer’s needs.

This procurement is necessary to modernize the existing Hologic Selenia Dimension System by upgrading the existing 2D capability to 3D capability. Hologic is the only vendor with an established DLA contract that can upgrade the Hologic Selenia Dimension from 2D to 3D capability due to the proprietary nature of the equipment. The existing configuration of the 2D system is limited to screening capability only, the upgrade will allow the unit to operate as both a screening and diagnostic capable unit. This upgrade to the mammography imaging equipment is necessary because it will result enhanced image quality, which is essential in the early detection of tumors that lead to breast cancer, as well as reducing the number of false positives. The upgrade consists of a combination of both proprietary software, OEM hardware, test phantoms, as well as operator and clinician training. This procurement also includes an upgrade to the display software package utilized by the clinicians to view, manipulate, and interpret the 3D images.

(5) The Hologic items required are available on the Hologic Radiology contract SPM2D1-09-D-8334.

The contract pricing has previously been determined fair and reasonable via comparison with commercial pricing and other than cost or pricing data. The Contracting Officer determined that the subject procurement represents the best value to the Government.

(6) DLA Troop Support continues to perform market research on the availability of mammography equipment and technology that can support the needs of DLA Troop Support customers. The results of current market research indicate Hologic is the only known supplier that can meet the requirements of NMC Groton. The overall system requirement won't be competed until this equipment reaches its end of life.

(7) There are no other facts supporting the use of this JEFO.

(8) As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge.
