JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY (JEFO)

(1) Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment

Division, is the contracting activity.

(2) The action submitted for approval is a JEFO for the acquisition of Draeger anesthesia machines under Draeger Medical, Inc. ECAT contract SPE2D1-14-D-7000 valid through August 2017.

(3) The required items are thirteen (13) Fabius Tiro anesthesia machines for the USNS Comfort (TAH 20). The total estimated dollar value of this action is .

(4) The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(b), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. The Draeger anesthesia machine identified above is the only product that can meet the customer’s needs.

This procurement is necessary to replace existing Draeger anesthesia machines on the USNS

Comfort. The Navy has standardized on the Fabius Tiro anesthesia machines for placement across the Fleet, including every operating room within the Navy’s 32 Amphibious Assault Ships and ten Aircraft Carriers, as well as both the USNS Comfort and USNS Mercy hospital ships, resulting in an installed base of 84 Fabius Tiro anesthesia machines. The Navy is currently replacing 13 of these machines which are failing due to the age of the machines.

The Draeger Fabius Tiro anesthesia machines are needed to sustain equipment supportability onboard ships. The Fabius Tiro is the standard equipment approved for onboard use and contained within the Authorized Medical Allowance List (AMAL) to meet operability, maintainability, and sustainment for operations at sea and in expeditionary ashore environments. Integrated Logistics Support (ILS) documentations is developed to support each piece of equipment that includes Authorized Parts Lists (APL), Preventive Maintenance System (PMS) procedures, and Navy Technical Manuals. Deviation from this standard approved equipment allowance will result in the equipment being unsupported and have negative impact on patient care aboard ship, including lack of anesthesia capability which is critical to providing medical care.

Only Draeger equipment can be used in order to maintain continuity of patient services and compatibility with existing Draeger anesthesia machines that will continue to be used on the ships.

Employees are already trained on Draeger equipment, existing maintenance resources can be used, no maintenance training would be required, considerable administrative efficiencies can be achieved, existing information technology resources can be re-used and shipyard approved designs favor the Fabius Tiro.

(5) The Draeger items required are available on the Draeger Patient Monitoring contract SPE2D1-14- 0004 and Draeger Medical administrative ECAT contract SPE2D1-14-D-7000. The contract pricing has previously been determined fair and reasonable via comparison with commercial pricing and other than cost or pricing data. The Contracting Officer determined that the subject procurement represents the best value to the Government.

(6) DLA Troop Support continues to perform market research on the availability of patient monitoring systems and upgrades. The results of current market research indicate Draeger Medical is the only

known supplier that can meet the requirements of the USNS Comfort. The overall requirement will be competed at the end of the commercial life of the Draeger Fabius Tiro.

(7) There are no other facts supporting the use of this JEFO.

(8) As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge.
