JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Training Systems Division (NAWCTSD) - Orlando, FL

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes and approves the issuance of a sole source Firm-Fixed Price contract for the procurement of Japan Air Self Defense Force (JASDF) E-2D Weapon System Trainer (WST) 15F14-J spares support package to:

Rockwell Collins Simulation & Training Solutions (RCSTS) 22640 Davis Drive Sterling, VA

Negotiated prices at time of contract award will be limited to the items detailed in Section 3 below.

3. Description of Supplies/Services.

The purpose of this contract is for NAWCTSD to procure an initial spare and repair parts package in support of the JASDF WST in accordance with the Letter of Approval (LOA) JA-P-NAV. Attachment (1) is the Spares Support Package.

This Spares Support Package procurement will be funded with Foreign Military Sales (FMS) type funds with a total estimated value of No other funding type will be used in any subsequent year. The contract funding profile is delineated in the table below.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

RCSTS is the sole source provider for development and production of the E-2D JASDF WST. The majority of hardware/software installed on the trainer will be configured to particular JASDFs specification. RCSTS will manage the procurement, spares configuration, labeling, storage, and packaging of all spare parts. It is critical for the spares to be coordinated and shipped intact to ensure parts arrive at the same time. As the OEM of the E-2D JASDF WST, RCSTS is the only source able to manufacture/obtain the spares identified in Attachment (1) in the timeline required to ensure that the spares supports package maintains configuration management of the with the WST and arrives intact.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Pursuant to FAR Subpart 10.001(a)(2)(ii), market research has been conducted to determine if a commercial item is available to satisfy the Government's requirement, or if the Government's requirement could be modified such that a commercially available item could satisfy the Government's requirements. It has been concluded neither of these options are viable.

In accordance with PGI 206.302-1, the Procuring Contracting Officer (PCO) issued a Sources Sought notice to Federal Business Opportunities (FedBizOpps) via the Navy Electronic Commerce Online (NECO) on 4 Jun 2919. The intent of the notice was to seek information on the availability of alternative sources to provide a spares product support package. The Government did not receive any responses.

In accordance with FAR 5.201, the PCO issued a Pre-solicitation notice to FedBizOpps via the NECO on 14 Jun 2019. The intent of the notice was to ensure full consideration is given to all potential sources.

The Government did not receive any responses.

RCSTS is the sole source of the JASDF WST Spares Support Package.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR Part 15.402(a), the Contracting Officer shall ensure that all supplies provided under this contract are procured at a fair and reasonable price. The contractor will submit a formal cost proposal with other than certified cost and pricing data in accordance with FAR 15.403-3 and sufficient information to support the accuracy and reliability of the price. RCSTS’s proposal will be reviewed by experienced technical analysts and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price. Price analyses will be conducted in accordance with FAR Part 15.404-1. Lastly, historical contract cost data and other relevant information will be utilized in the establishment of a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

For the reason set forth in Paragraph 5, NAWCTSD has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NAWCTSD Orlando will assess whether competition for future requirements is feasible.
