JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPE7M220R0004
DLA Land & Maritime Justification for Other Than Full & Open Competition
(FEB 2017)

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. The action being approved is the acquisition of supplies on other than a full and open competition basis.
3. The supplies required to meet the using activity’s needs are described as follows:

Identify end item, weapon system, or class of item: Critical Safety Item, SPC “01” used on the Aircraft Launch and Recovery Equipment (ALRE). Item is Coded 82N with a WSIC of “F”. Failure of this item will render end item inoperable.
ESTIMATED BASE VALUE: 40 EA
ESTIMATED TOTAL VALUE + RANGES: up to 60 EA
A previous J&A is attached for Contract No. SPE7M218C0047 AMC/AMSC codes were reviewed by the Product Specialist of record on September 13, 2019.
4. The statutory authority permitting other than full and open competition is:
[ X] 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.
5. If restricted to the only source(s) of supply, include source(s) and CAGE code: The Government is restricting procurement to one (1) approved source (97415) Triumph Actuation Systems.
This item is a Critical Safety Item. In accordance with DFARS 209.270-3, DLA must procure from NAVAIR
(design control activity) approved sources for ALRE Critical Safety Items. In addition, NAVAIR INST
4200.56 states the following with regard to sources. Per references (a) and (g), a CSI shall be purchased or repaired and/or overhauled only from sources approved by the Technical Agency. References are as follows:
(a) Public Law 108 136, Sec. 802, Quality Control in Procurement of Aviation Critical Safety Items and Related Services and (g) SECNAVINST 4140.2. Triumph Actuation Systems is the only source approved by NAVAIR for this CSI item and, per DFARS 209.270-3, DLA must only procure Triumph Actuation Systems’ part numbered item.
The use of the authority cited below:
[X] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
The use of the authority cited is based on:
[ X ] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.
Item is made to NAVAIR drawings and available for download, however, NSN is coded 3 C due to source approval by NAVAIR and NAVSUP. This is a flight safety item/critical safety item with a special procedures code of (01). The cage cited in paragraph 5 has the appropriate manufacturing expertise and quality capabilities to supply this NSN. The acquisition of only the currently approved source’s part numbered item is required to maintain the quality of the part.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
[ X ] The acquisition will be synopsized on or about January 6, 2020 for 15 days.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. DLA has procurement history in which prior prices were determined to be fair and reasonable. Price analysis will be conducted using historical pricing. Other Than Cost and Pricing Data may be obtained to support a fair and reasonable price.
8. Market Research/Efforts to Obtain Competition:
Market Survey [10 U.S.C. 2304(f)(3)(D)]:
[ X] A market survey was conducted on/during October 24, 2019 to October 31, 2019.
Total number of vendors contacted: 1
Names of vendors contacted and responding: Contacted Triumph Actuation Systems with no response.
Techniques used to conduct survey: Posted a Sources Sought on October 24, 2019 for 5 business days with attached market survey to FedBizOpps. Sources Sought produced no responses. Emailed Triumph Actuation Systems with a request to complete the market survey.
Types of information requested: Business size, estimated price and delivery, economical quantities, commerciality, purpose and function, and capability to provide Cost and Pricing Data.
Summary of information received: Triumph Actuation Systems did not respond to the request to complete a market survey questionnaire. Price and delivery was obtained from a quote submitted by Triumph Actuations Systems on the original request for quotation (RFQ) for this procurement.
9. Additional facts supporting other than full and open competition are:
[ X ] Other: (Explain) This is a Critical Safety Item with an SPC code of ‘01’. Naval Air Systems Command, Lakehurst (NAVAIR) is the design control activity and determines which manufacturers are capable of producing the item to its CAI requirements. NAVAIR provides one (1) approved source. According to NAVAIR (97415)
Triumph Actuation Systems is the only manufacturer having been identified as having the proven capabilities and quality processes for manufacturing.
10. A listing of sources, if any, indicating an interest in the acquisition is: (97415) Triumph Actuation Systems.
Triumph did not respond to the market survey, but submitted a quote in response to the original RFQ for this procurement, which was cancelled.
11. The following actions are being taken to identify additional sources:

Any manufacturers who would like to pursue source approval will receive source approval guidance for submission of a SAR package to the design activity, NAVAIR.
