JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
This Justification and Approval (J&A) is to request authority for Other Than Full and Open Competition in the requirement generated by NAVSUP FLC Bahrain Code 420 Fleet Mail Center (FMC). The contracting authority for this requirement is NAVSUP Fleet Logistics Center (FLC) Bahrain.
2. Description of the Action Being Approved
Due to the circumstances described herein, this activity requests authority to acquire Mail Handling Services as listed in this document using Other than Full and Open Competition, as prescribed by FAR 6.302-l(a)(1) - Only One Responsible Source and No Other Supply or Service Will Satisfy Agency Requirements. This action will result in the award of a bridge contract, which will be a firm-fixed price, one-time buy. This requirement will be sole-sourced to:

3. Description of Supplies/Services
This requirement is to provide Mail Handling Services within the Bahrain International Airport (BIA).
This requirement includes the provision of overall management, vehicles, tools, supplies, equipment, labor and supervisory services necessary to ensure U.S. Forces Military Mail services are performed in accordance with (IAW) sorting and dispatching requirements established by the United States Postal Service (USPS), Military Postal Service Agency (MPSA), Joint Military Postal Activity (JMPA), Department of the Navy (DON) and FLC Bahrain Mail Handling Instructions and standard operating procedures (SOPs). This contract action will have an estimated total value of
. The period of performance will include a six-month base period from 1 September 2022 through 28 February 2023 and a six-month option period from 1 March 2023 through 31 August 2023. FY22 Navy Operations and Maintenance funding in the amount of will be used in the associated task order to fund the six-month base period.
4. Statutory Authority Permitting Other Than Full and Open Competition
The proposed procurement is to be made pursuant to statutory authority under 10 U.S.C. 2304(c)(1) - Only One Responsible Source and No Other Supply or Service Will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority
For the proposed bridge contract, the identified source is the incumbent, DHL International B.S.C.
Only DHL International B.S.C currently has the required licenses and the facility to perform mail handling services at the Bahrain International Airport.
A bridge contract is determined essential to provide the Government sufficient time to conduct a new procurement for the follow-on contract that will address existing concerns, maximize competition and avoid a lapse in critical services for mail handling services.
A complete loss of mail handling services will have a catastrophic impact on mission readiness for all commands, active service members and civilian personnel in the Kingdom of Bahrain. Lack of contractual coverage would result in unacceptable delays and difficulties in the sorting, storage and shipment of mail packages which will cause serious injury, financial or other, to the Government.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
The Contracting Officer solicited full and open competition under the previous Request for Proposals (issued in 7 July 2022) to maximize competition. The performance work statement for the follow-on contract required the successful contractor to have in their possession all necessary licenses and facility required for them to perform the requirement at the Bahrain International Airport.
However, after the solicitation was issued, only one (1) vendor (the incumbent) submitted a proposal in response to the solicitation.
This requirement will not be synopsized on the Contract Opportunities module of the System for Award Management website or to the Government Point of Entry as required by FAR 5.201. In accordance with the DFARS PGI 206.302-1, the Head of the Contracting Activity (HCA) or designee has waived the requirement of posting a Request for Information or Sources Sought synopsis for this J&A.
7. Determination of Fair and Reasonable Cost

. The Contracting Officer expects the anticipated cost to the Government of the supplies/services covered by this J&A to be fair and reasonable IAW FAR 15.404-l(b)(2)(ii) Comparison with historical prices paid by the Government for the same services.
8. Actions to Remove Barriers to Future Competition
A new Sources Sought Notice will be issued to identify interested vendors that has the required licenses and facility to perform the requirement.
Approval of this RABC will constitute a waiver of the requirement to post a Request for Information or a Sources Sought Notice and include the results of the posting in the justification, as prescribed in DFARS PGI 206.302-1.
The follow-on contract is estimated to be awarded NLT 31 January 2023.
