JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPE7M221Q0017
DLA Land & Maritime Justification for Other Than Full & Open Competition (May 2018)

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. The action being approved is the acquisition of supplies on other than a full and open competition basis.
Simplified acquisition Procedures are being used in accordance with FAR 13.5.
3. The supplies required to meet the using activity’s needs are described as follows:

Identify end item, weapon system, or class of item: 4440-01-190-6213 is described as a Honeycomb Desiccant Rotary Dehumidifier used on /with main reduction gear, submarine hatch and surface craft. Item is used by the Navy for Weapon System 21N, Nuclear Reactors Program. Item is only manufactured by CAGE 82974 Munters Corporation DBA Munters, P/N GC-150 D30116.
Estimated Dollar Value = CLIN 0001 156 EA.
Total Estimated Dollar Value with ranges up to 200 EA.
A J&A for the previous buy, SPE7M220P2006, is attached.
The Acquisition Specialist used the survey completed by Munters on June 23, 2020, and the market research information obtained for that procurement for the preparation of this document as well as other acquisition planning documents. The product Specialist of record conducted a review during the market research phase, and AMC/AMSC is 3Z. The desiccant dehumidifier, NSN 4440-01-190-6213 is coded as a commercial off the shelf (COTS) item. The unit is used to control the air in large areas containing electrical equipment, military equipment and food storage. The item is used on ships, in hotels and other commercial buildings.
The Product Specialist was able to provide characteristics/features of the item, listed below; however, these are incomplete for purposes of an item description necessary for the Government to pursue Brand Name or Equal (FAR 52.211-6). A breakout request for salient features as “actions to overcome barriers to competition” was sent via a 339 to ESA. A response from the Navy was received on August 25, 2020 recommending that the NSN remain sole source. The Navy does not have the rights to use Munters’ drawing competitively. The performance requirements for the NSN found in the Navy technical manual for the Munters unit is distribution statement B (government only).
The Navy provided other reasons for limiting procurement to Munters which includes the following:
-Any competitive replacement to the present unit will require HI-Shock MIL-STD-901C testing as well as vibration qualification.
-The present unit has an established space envelope, weight and interfaces (mounting hole pattern, piping flanges, electrical connections). Any growth in size or changes to interface may require significant follow-on actions and expenses.
-Technical manuals, drawings, provisioning, and maintenance documents refer specifically to the GC-150, which would require updating.
Features for Military and Commercial Customers:
Characteristics of this NSN that are essential to the end user:
- Efficient humidity control for applications including product drying, mold and mildew control, corrosion protection, storage and condensation control
- Durable unitized body with welded aluminum construction
- Easy access panel for inspection and maintenance
- Simple ductwork connections
- Compact, low profile design
Features that are essential to the end user:
- Process Air: flow rates of 125-150 scfm at 2" ESP. Nominal moisture removal: 2-4 lbs/hr. Capable of processing saturated, conditioned or outside air.
- Reactivation Air: flow rates of 40-50 scfm at 0.2" ESP.
- Electrical Controls: continuous automatic operation with motor starters, control relays and overload protective devices.
- Drive System: simple drive belt arrangement, few moving parts.
- Rulon air seals: separate process and reactivation air. Minimum leakage. 5 year life expectancy.
- Process, Reactivation and Booster Fans: centrifugal, direct drive totally enclosed non-ventilated.
- Dehumidifier Housing: process and reactivation air flow insulation. Blower motors and controls isolated from air streams. Volume control dampers for process and reactivation air streams. All welded aluminum cabinet.
4. The statutory authority permitting other than full and open competition is:
[ X ] 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.
5. If restricted to the only source(s) of supply, include source(s) and CAGE code: CAGE 82974 Munters Corporation DBA Munters, P/N GC-150 D30116. At this time, CAGE 82974 Munters is the only known manufacturer. While the item is commercial, it is necessary to obtain the item from Munters because the Navy requires that the unit pass navy shock and vibration tests and much of the construction process is patented by Munters.
The use of the authority cited below:
AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
The use of the authority cited is based on:
AMSC Z. This part is a commercial/nondevelopmental/off-the-shelf item. Commercial item descriptions, commercial vendor catalog or price lists or commercial manuals assigned a technical manual number apply. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources are available, AMCs 1 or 2 are valid.
Manufacturer catalogs exist, but an interchange catalog was not available. See paragraph 8.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:

10. A listing of sources, if any, indicating an interest in the acquisition is: (82974) Munters and (8DDH4) Siegfried Consultants LLC.
11. The following actions are being taken to identify additional sources:
