OPEN COMPETITION (OTFAOC)

Justification for OTFAOC Number: JA21-022

Upon the basis of the following justification, I, as Senior Procurement Executive (SPE), hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of 10 U.S.C. 2304(c)(2).

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

2. NATURE/DESCRIPTION OF ACTION(S):

This procurement will establish a new cost-plus-fixed-fee contract line item with an estimated lifecycle value of on existing contract number HC1028-17-C-0001, which is primarily a cost-plus-incentive-fee contract. The emergence of operational needs like Sensor-to- Shooter (S2S) and Joint All Domain Command and Control (JADC2) have highlighted the shortcomings of the current architecture and emphasized a need for immediate modernization of the system in order to keep pace with emerging real-world operational requirements. S2S efforts include key components to include Long Range Precision Fires, Extended Range Cannon Artillery and Hypersonic that are emerging capabilities on the modern battlefield. The number one modernization priority in the Secretary of the Army’s guidance from October 2017, and remains an Army priority, is a Long-Range Precision Fires capability that restores U.S. Army dominance in range, munitions and target acquisition. The Secretary of the Army’s guidance is based on the National Defense Strategy, Page 3 of 7 Pages fielding (October 2022 – May 2024). Additionally, AFATDS 7.0 must be developed in parallel with AFATDS 6.8.1.3, which precludes testing, assurance, material release and FUE fielding from occurring prior to the scheduled timeline ending in May 2024.

The development effort needs to start in January 2021 in order to meet objective fielding timelines for AFATDS 7.0. If the objective fielding timeline is not met, the force will be at an increased risk of communications disruption, as cyber vulnerabilities would continue to exist in the problematic code of Legacy AFATDS. Additionally, units will be relegated to an inferior user interface and training component, which will have long term functionality impacts on the force. The development effort for the manual code conversion effort would conclude in October 2022; however, if Leidos is not on contract for the remainder of the effort, then the Government would be in an untenable position of conducting Army Interoperability Certification (IAC), other test activities and material release without support. The final 18 months of performance will be in a greatly reduced role, as the program moves into testing, material release and FUE fielding.

DISA Senior Procurement Executive approval is required for this J&A to comply with the determination and approval requirements at FAR 6.302(d)(1)(ii), which provides that the total POP for contracts utilizing the unusual and compelling urgency authority may not exceed one year, including all options, unless the head of the agency (for contracting matters) determines that exceptional circumstances apply. The total POP for this effort will be 40 months. A transition to another contractor was determined not to be an acceptable approach by the Program Executive Office as the Government would be retaining an extremely high level of risk as it moves through fielding. Technical publication validation, verification and approval, safety release, cyber validation and gaining authority to operate (ATO) are all activities for which the Government requires contractor support for success. Failing to provide an 18-month POP beyond the development effort would require the Government to operate at an unacceptable risk level and without contractor support through testing, material release, and FUE fielding activities; including manual development, training support package documentation, U.S. Army Training and Doctrine Command verification and validation, gaining material release from U.S.

Army Test and Evaluation Command, Army Interoperability Certification (AIC) and ATO completion.

In order for AFATDS to be ready to adapt to new emerging requirements, it must undergo the modernization efforts encompassed in AFATDS 7.0. Once this modernization is complete, a long term foundation will be in place to competitively solicit new emerging capabilities to continue to keep AFATDS relevant for the foreseeable future.

4. IDENTIFICATION OF STATUTORY AUTHORITY: Unusual and compelling urgency, 10 U.S.C. 2304(c)(2). (FAR 6.302-2)

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:

(a) Description of events.

(1) Modernization must include developing the multi-domain operations concept at echelon.

Critical to this effort is the use of a digital S2S framework. As Legacy AFATDS continued to adopt capability requirements in the first half of 2020, it became abundantly clear that AFATDS 7.0 without compatibility would result in an untenable product.

Government is fair and reasonable, based on comparison to the Independent Government Cost Estimate and historical pricing in relation to HC1028-17-C-0001. All rates set forth in the contract were determined fair and reasonable. The Contracting Officer will also seek additional discounts during final negotiation prior to award.

8. MARKET RESEARCH:

Market research focused on the incumbent and plausible courses of actions for reasons mentioned in section 5(a). Due to the nature of this requirement, market research concludes that in order to meet the unusual and compelling urgency aspects that only the aforementioned solution can be provided by Leidos. Alternate strategies were considered and rejected due to the extended lead times required to ramp up a new contractor without creating excessive security risks. If the work was placed on another contract vehicle, or if a full and open competition was conducted, the threshold fielding timeline would not be achievable. The effort must begin in January 2021 in order to execute AIC in the requisite window for fielding.

A sources sought was not conducted due to the unusual and compelling urgency of this requirement.

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

(a) Procurement History. Contract Number HC1028-17-C-0001 was not a follow-on contract action. It was solicited and awarded under FAR Part 15 full and open competition. Four proposals were received from large businesses to include:

- Northrop Grumman Systems Corporation (NGSC)

- General Dynamics Mission Systems (GDMS)

- Raytheon

- Leidos

(b) There is no expectation of future barriers to competition. This unusual and compelling contract action is privy only under this contract and is related to extraordinary events directing the need to re-prioritize. Upon completion of this contract, a competitively awarded contract will be utilized for continued maintenance and support and fielding of the solution. As such, future actions will be able to be competed IAW all regulatory standards.
