SINGLE SOURCE DETERMINATION USING
SIMPLIFIED ACQUISITION PROCEDURES (SAP) UNDER THE
SIMPLIFIED ACQUISITION THRESHOLD (SAT)
AUTHORITY: FAR 13.106-1(b)(1)
CONTRACT # 140D8019PF001
1. Contracting activity/agency.
This document is a sole source justification for the Department of the Interior (DOI), Interior Business Center (IBC), Acquisition Services Directorate (AQD), Division IV, Branch IV, Boise, Idaho in support of the Office of Aviation Services (OAS) Boise, ID and the US Fish and Wildlife Service (USFWS).
2. Description of supplies or services required to meet agency needs.
The Government has a requirement for a charter flight with pilots and crew for an estimated eight (8) passengers (7-Government-identified passengers and 1-Prisoner) to travel from Entebbe, Uganda to New York - White Plains (HPN). The flight shall take place with a departure from Entebbe on June 10, 2019 (Uganda time); arriving in New York - White Plains on June 11, 2019. The operator shall be US-based, and the aircraft shall be US-registered and owned by US citizens. The crew shall all be US citizens.

4. Reason for authority cited.
The contracting officer has determined the circumstances of the contract deem only three sources reasonably available.
Urgency – The nature of the requirement has been deemed urgent and following competitive procedures would result in unacceptable delays.
5. Rationale.
This requirement was realized on 26 April 2019, when it was discovered that commercial air could not be used to transport the prisoner due to political and jurisdictional considerations.
However, the exact date of the operation was unknown at the time since the target had not yet been indicted. On 07 May 2019, the target was indicted and an arrest warrant was issued.
This resulted in an operation date being set for 10 June 2019, which will require that an urgent

award is made to support it. Due to the urgent nature of the requirement, it has been determined that only three (3) sources will be solicited.
The flight being requested is for a sensitive Law Enforcement mission to pick up a prisoner in Uganda and transport that prisoner to White Plains, New York. The mission is very sensitive and risk of exposure of the mission to the public could jeopardize the overall operation that includes arresting several other people throughout the continent of Africa that will be transported back to the U.S. via traditional commercial air or the U.S. Marshalls Service. This is a very unique mission for DOI and the USFWS Office of Law Enforcement and it is believed that if word of the request was widely disseminated it could potentially expose the purpose of the flight.
Secondly, this is a very unique mission for charter companies that require special sensitivities to be taken into consideration. The sources identified above have carried out a number of similar international missions in support of other US Government organizations, including the DEA, and understand the sensitivities associated with it.
Soliciting more than the three (3) sources listed herein, or using a company with little or no experience with this type of requirement would put the mission in extreme jeopardy.
6. Market Research.
Market research indicates that there are multiple small businesses that can complete this requirement; however, due to the sensitive nature and uniqueness of the requirement, only the three (3) sources listed above will be solicited. The three (3) vendors listed above are all small business that have performed this type of work successfully in the past.
