JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

SPRDL1-23-R-0154

1. Contracting Agency: The Contracting Activity for this action is the Defense Logistics Agency – Land Warren (DLA Land Warren).

2. Description of Action: DLA Land Warren proposes to award a new Firm-Fixed- Price contract to Eaton Aerospace, LLC. (Eaton), Commercial and Government Entity (CAGE) 62983, for National Stock Number (NSN) 1650-01-183-9529, Hydraulic Motor, using Army Working Capital Funds.

3. Description of Supplies/Services: The NSN 1650-01-183-9529, part number MF2- 009-6A (CAGE 62983), Hydraulic Motor is used on the AH-64D and AH-64E Apache Attack Helicopters. The deliverables for this proposed Three-Year Indefinite Delivery Indefinite Quantity (IDIQ) long term contract (LTC) are a minimum quantity of 27 each, with a maximum three-year order quantity of 375 each. The total estimated maximum dollar value of this contract is $

Two Hydraulic Motors are required on every AH-64D and AH-64E Apache Attack Helicopter. One Hydraulic Motor rotates the 30 millimeter (mm) gun turret to rotate in azimuth. The second Hydraulic Motor powers the 30mm ammunition conveyor system during M230 gunfire and ammunition magazine loading.

Acquisition Method Code (AMC): 3 - Acquire, for the second or subsequent time, directly from the actual manufacturer.

Acquisition Method Suffix Code (AMSC): H - The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than the current source(s). This code is applicable only to parts under immediate buy requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding. This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different AMSC. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 3204(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: Eaton is the Original Equipment Manufacturer (OEM) for the Hydraulic Motor. Eaton designed this Hydraulic Motor at their company's expense and owns the intellectual property and technical data package (TDP) to manufacture the Hydraulic Motor.

Additionally, the required performance, qualification and reliability testing would consume several scarce M230 gun and Area Weapon System components that are currently in short supply and may delay reverse engineering project completion.

6. Efforts to Obtain Competition:

Effective competition: Due to the reasons cited in Section 5 above, the Government is not pursuing competition for this item.

The notices required by FAR 5.201 will be posted.

7. Actions to Increase Competition: There are no known funding efforts in progress at this time to develop the competitive technical data required to make the Hydraulic Motor fully competitive. No contractors are in the process of being qualified at this time, nor will be prior to the contract award due to funding and resource constraints.

8. Market Research: A Sources Sought Notice was posted to SAM.gov on 30 June 2023 and was open for 15 days. One response was received from an interested vendor.

One response from a potential vendor was received in response to the Sources Sought Notice. Beacon Industries requested information on how to submit an offer for this requirement. The Contract Specialist informed the vendor that they could contact the Competition Management Office to apply to become an additional source for future requirements through the Source Approval Program.

The U.S. Army DEVCOM Armaments Center project engineer performed market research on 15 June 2023 to locate sources of supply other than Eaton. Using internet search engines and search terms such as " MF2-009-6A hydraulic motor", "MF2-009- 6A” and "NSN 1650-01-183-9529" yielded the following results:

Conclusion: the market research internet search did not identify a qualified hydraulic motor source other than Eaton.
