M109A6 Paladin and M109A7 Self-Propelled Howitzer causing injury, or damage to other vehicles, surroundings, and itself. The result would endanger the crew and render the Paladin and Howitzer Non-Mission Capable.
6. Efforts to Obtain Competition:
a. Effective competition: Due to the reasons cited in section 5 above we are not pursuing competition for this item.
b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, “Utilization of Small Business Concerns”; 52.244-5, “Competition in Subcontracting”; 52.219-16, “Liquidated Damages-Subcontracting Plan”; and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, “Small Business Subcontracting Plan (DoD Contracts)”, to maximize small business opportunities and utilization.
SOLE SOURCE: Notices required by FAR 5.201 will be posted.
7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.
As stated in Section 5 above, there is no build to print TDP available to support an unlimited competitive procurement. Kollmorgen is the sole owner of the defining drawings and technical data rights. The Government did not buy Kollmorgen proprietary rights to produce a competitive TDP. This item is specifically designed for TLAs for application to the M109A6/A7. Furthermore, due to the costs associated with developing a competitive TDP that cannot be recovered as stated in Section 5, the Government would not be able to recover the $1.91M to reverse engineer the TLA and thus not actively pursuing the development of a competitive TDP for future procurements.
8. Market Research: A Sources Sought Notice was posted to SAM.gov on 03 November 2022 and was open for 20 days. No responses were received.
In addition to the sources sought notices, an internet search was performed by the ESA in May 2023. According to the websites NSN-NOW.COM, ISO-GROUP.COM, WBPARTS.COM, NSNCENTER.COM, and PARTTARGET.COM, this NSN has only one active supplier that is deemed design controlled or has valid supply parts. The sites also note that the Government does not have in its possession the necessary Technical Data sufficient to enable a competitive acquisition and to acquire directly from the actual manufacturer, whether or not the prime contractor is the actual manufacturer.
ESA attended the Michigan Defense Expo in April 2023 and saw no such vendors whom supplied a comparable part.
