JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

SPRDL1-21-R-0056

1. Contracting Agency: Defense Logistics Agency - Land Warren (DLA-WRN).

2. Description of Action: DLA-WRN proposes to award a new, Firm-Fixed-Price contract to Grove U.S., LLC, Contractor and Government Entity (CAGE) code 12361, for National Stock Number (NSN) 3040-01-207-6376, Cylinder Assembly, Actuating, Linear, using Army Working Capital Funds (AWCF).

3. Description of Supplies/Services: The NSN 3040-01-207-6376, part number 6- 372-002614, Cylinder Assembly, Actuating, Linear, is used on the M984A4 Wrecker.

The deliverables for this contract are a base quantity of 13 each, with an option quantity of 13 each, making a total quantity of 26 each. The total estimated maximum value with option of this contract is $ .

This actuating outrigger cylinder is a component to the Heavy Expanded Mobility Tactical Truck (HEMTT) fleet. The end item is the M984A4 Wrecker. The component is utilized in the crane and winch system to stabilize the vehicle by raising the lifting end of the vehicle to give it two stable ground points, allowing for full utilization of the wrecker equipment.

Acquisition Method Code (AMC):

3 - Acquire, for the second or subsequent time, directly from the actual manufacturer.

Acquisition Method Suffix Code (AMSC):

R - The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part.

This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 USC 2304(c) (1), as implemented by Federal Acquisition Requirement (FAR) 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: The Government does not have rights to the Technical Data Package (TDP) or specifications.

The original equipment manufacturer (OEM) for the HEMTT is Oshkosh Defense. The part has been sourced from approved manufacturer Grove U.S., LLC, (CAGE 12361).

7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.

There are no contractors currently in the process of being qualified as an alternate source of supply for this time. There are no current or planned efforts to qualify additional sources due to the fact that the Government does not possess a fully-defined and validated TDP for this item. The source of supply, Grove U.S., LLC, has access to the detailed technical data regarding this item.

8. Market Research: A Sources Sought Notice was posted to beta.SAM.gov on 23 February 2021 and was open for 16 days. One response was received. See assessment of the response in Section 9 below.

Given that no technical data is available for the Cylinder Assembly, Actuating, Linear (NSN 3040-01-207-6376), market research results are very limited. Internet searches yielded several different companies that manufacture similar products, however, without having detailed technical information and/or quality requirements, it is difficult to find a company or product that would perform at the same fit, form, and function of the current part. The internet search was conducted by the Project Engineer during March of 2021.

The information found was too generic and broad and therefore not useful due to not having technical data. Similar units are available, but the variation in performance specifications make it impossible to determine whether each unit could meet the specific needs for this application. When and if the technical information for the Cylinder Assembly, Actuating, Linear, is eventually made available, specific market research can then be conducted and a competitive procurement considered. Another detail is that this part is an assembly, the current supplier, Grove U.S., LLC, would also have the capability of supplying the entire assembly.

One response was received in response to the Sources Sought Notice from North American Controls, Inc. No formal qualification is known to have started.
