JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
SPRDL1-21-R-0093
1. Contracting Agency: Defense Logistics Agency - Land Warren (DLA-WRN).
2. Description of Action: This proposed contract action will result in DLA-WRN awarding a new, firm-fixed-price contract to Oshkosh Defense, LLC (Oshkosh), Commercial and Government Entity (CAGE) 75Q65, for National Stock Number (NSN) 2520-01-592-8298, axle assembly, automotive, driving.
The axle assembly, automotive, driving, NSN 2520-01-592-8298, is used on the Heavy Equipment Transport (HET) M1070, A1 configuration.
Army Working Capital Funds (AWCF) will be used for this procurement.
3. Description of Supplies/Services: Oshkosh will provide the axle assembly, automotive, driving, NSN 2520-01-592-8298, Manufacturer Part Number 3815350 from Oshkosh (CAGE: 75Q65). The deliverable for this contract is for a base quantity of 12 each, with no option quantity, making a total quantity of 12 each. The total value of this contract is .

3 - Acquire, for the second or subsequent time, directly from the actual manufacturer.
Acquisition Method Suffix Code (AMSC):
R - The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.
4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Reason for Authority Cited: This axle assembly, automotive, driving, is located in the front of the vehicle and is responsible for driving and steering the front wheels of the M1070. The M1070 is coupled with the M1000 semi-trailer, and its primary purpose is the transport of the M1 Abrams, which itself weights upwards of 70 tons. The axle assembly, automotive, driving, is powered by a driveshaft from the transfer case and contains all the necessary steering components.
The Government does not own nor have rights to the Technical Data Package (TDP).
The axle assembly, automotive, driving, is manufactured by Oshkosh-approved distributors and vendors. Only Oshkosh, through their distributors and vendor network, has the specific technical expertise and proper facilities to manufacture the axle assembly, automotive, driving. Oshkosh built and qualified this axle assembly at their own cost, and the Government did not procure rights to the TDP.
Oshkosh has manufactured these automotive axle assemblies, which have gone through extensive qualification testing. The axles have gone through verification tests such as maximum load operation, vibration analysis, environmental/accelerated life testing, in addition to field level testing. If the Government were to purchase assemblies that have not undergone proper verification, mission failures and potential loss of mission critical functions to the vehicle could occur. Without this proper verification, it is possible that the axle assembly, automotive, driving, would not fit or function properly, which could result in vehicle failure while transporting the M1 Abrams Tank, which could jeopardize mission capability and fleet readiness.
After receiving input from the Ground Vehicle Systems Center (GVSC) Reverse Engineering (RE) Team, it is estimated that RE of this axle assembly, automotive, driving, would cost $4M for design, development, testing, technical data development, and finding a new source to build the assembly to a fully competitive TDP. (See table below for breakdown of costs).
Since the Government does not own any of the technical data, the Government would have to RE the axle assembly, automotive, driving, in order to determine all aspects of the assembly. An RE effort would include work to clarify and define an assembly with the same fit, form, and function as the original axle assembly, automotive, driving.
Design requirements would need to be broken down and clarified without any ambiguity.
Technical information, such as understanding the parameters on gear type, gross axle weight and gross combination weight, number of splines, spline diameter, axle housing dimensions, and mounting dimensions would need to be researched and gathered.
Developmental testing is needed to prove the prototype is functional. Component, Safety, and System Level Testing would evaluate the assembly’s compliance with the specified requirements. Once all testing and design is complete, a TDP would need to be produced. Reliability and Operational Testing includes accelerated life testing, cold and hot environments, salt spray, and maximum load operation.

Dana offers multiple axle assemblies based on gross axle weight, axle housing size, gear ratios, maximum gross combination weight, and ring gear diameter. These axles only appear to be single-drive axles, though, with no offerings of steerable axles.
Meritor has an extensive variety of axle assemblies, including a separate category for front-drive axles. The engineer obtained detailed specifications and reviewed technical and performance characteristics for all of the Meritor front-drive axles. They have a variety of applications, including heavy industrial, mobile cranes, and an application on the Family of Medium Tactical Vehicles (FMTV). Technical information such as overall ratios, load rating, brake torque, wheel diameter, bolt circle diameter, maximum inside and outside steering angles, and overall dimensions of the axle assembly are needed to find the appropriate configuration. The Government does not have any of this technical information needed to continue further research.
Summary: As a result of the market research, it was concluded that the Government does not have sufficient technical information to identify alternative sources for the M1070 HET axle assembly. With the system level requirements and design being proprietary, it can be said for certain that this axle assembly is custom for the application and cannot be identified as a commercial off-the-shelf item.
