JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Agency: The Contracting Activity for this action is the Defense Logistics Agency - Land Warren (DLA Land Warren).
2. Description of Action: DLA Land Warren proposes to award a new Firm-Fixed- Price contract to FMC Corporation, Cage 71454, for National Stock Number (NSN)
4320-01-351-8586, Pump, Triplex, HP, using Army Working Capital Funds (AWCF).
3. Description of Supplies/Services: The NSN 4320-01-351-8586, manufacturer part number 5266613 / Pump, Triplex, HP, is a positive displacement high pressure pump used on the end item 3,000 (3K) gallons per hour (GPH) Reverse Osmosis Water
Purification Unit (ROWPU). The deliverables for this contract are for a base quantity of 3 each, with an option quantity of 3 each, making the total maximum quantity of 6 each.

Acquisition Method Code (AMC): 3 - Acquire, for the second or subsequent time, directly from the actual manufacturer.
Acquisition Method Suffix Code (AMSC): R -The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.
4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Will Satisfy Agency Requirements.
5. Reason for Authority Cited:
This item is a high pressure, positive displacement, plunger pump that provides the 1,000 pounds per square inch (psi) required to push the pre-treated water through the Reverse Osmosis (RO) membranes at a rate of 101 gallons per minute (GPM). The pump is made of a corrosion resistant nickel aluminum bronze that is suited for salt water operations.
FMC Corporation has developed, tested, and obtained the Government’s approval of

Previous J&A (SPRDL1-09-R-0233) this item for application to the 3K GPH ROWPU assemblies at their own cost. The Government provided no funding for this effort. A 2000 hour test would need to be performed on a new pump in order to prove out the user's reliability requirement at a cost of $200K. If this time consuming and costly test on a new pump is not performed, then it is a higher risk that major reliability issues would be present in the field.
The Government does not have rights to the Technical Data Package (TDP) or specifications. The Government did not fund them to prepare a fully detailed TDP after approval. For these reasons, the item is source controlled. This is the only approved part number when procured from the original equipment manufacturer and approved distributors listed below by the Combat Capabilities Development Command Ground Vehicle Systems Center (CCDC GVSC), for use on the 3K GPH ROWPU:

To make this item competitive it would have to be reverse engineered and a new TDP would have to be created. Testing would need to be performed, which would cost approximately $200K, based on a 2000 hour test as mentioned above. The testing costs alone are cost prohibitive considering there are no funds available for this action.
Preparing a new specification or a competitive TDP through reverse engineering makes it even more cost prohibitive. Based on previous experience, we estimate that the cost to develop a competitive package for this item could run as high as $750K.
The Government would not be able to recover through subsequent competition the additional costs involved in reverse engineering the item to create a new and competitive high-pressure pump package. At the current average usage rate of approximately 1 unit every 3 years (per the Item Manager), a current unit cost of
, and assuming the 25% savings achieved through competition, the in annual savings would take over years to offset the estimated $950K cost of reverse
Previous J&A (SPRDL1-09-R-0233) engineering the item and qualifying another source through testing.
Scheduling is of concern due to the ongoing rebuild program at Sierra Army Depot, as well as backorders described by the Item Manager. The estimated delay of at least twenty-four (24) months to include releasing a validated TDP and testing is not acceptable to support the Sierra Army Depot rebuild program as well as sustainment of fielded systems.
6. Efforts to Obtain Competition:
a. Effective competition: Due to the reasons cited in section 5 above the Government is not pursuing competition for this item.
The notices required by FAR 5.201 will be posted.
7. Actions to Increase Competition: There are no known funding efforts in progress at this time to develop the competitive technical data required to make the Pump fully competitive. No contractors are in the process of being qualified at this time, nor will be prior to the contract award due to funding constraints.
8. Market Research: conducted internet searches during the week of 21-25 Sep 2020, which revealed the websites listed in the section below as potential alternatives to the FMC Pump.
Contacted Process Systems, Inc. (CAGE 1XLG4) on 25 September 2020, to verify that FMC (CAGE: 71454) is still making part.
Response received on 7 October 20 confirming availability. Delivery was stated to be 31-32 weeks after receipt of award.

Findings: These are the only sources found with pumps in the same flow capacity and pressure rating category. However, none have the exact same form, fit and function as the FMC pump and would require significant design changes to the end item in regards to mounting configuration, interface with other components and plumbing both to and from the Pump. These changes would likely cause interference or incompatibility with associated components of the pumping system as a whole and would require extensive changes to those components in order to interface with the 3K ROWPU's high pressure pump skid assembly. These changes would need to be extensively engineered and tested to ensure proper operation, safety and performance of the system as originally designed.

9. Interested Sources: A Sources Sought Notice was posted to beta.SAM.gov on 10/12/2020, and was open for 15 days. Two (2) responses from vendors were received in response to the Sources Sought Notice posted on beta. SAM and are listed below.
1. Pivotal Pumps notified the Contract Specialist of their interest in becoming a potential supplier of this Pump on 19 Oct 2020. The Contract Specialist notified the TACOM Competition Management Office of this inquiry, which was assigned CMO Case # 2021-
012. Pivotal Pumps responded on 26 Oct 2020 that they would look at providing the Pump as a distributor and is not looking to be an approved source at this time.
2. Mavec Advisors notified the Contract Specialist of their interest in becoming a potential supplier of this Pump on 10 Nov 2020. The Contract Specialist notified the TACOM Competition Management Office of this inquiry, which was assigned CMO Case # 2021-018. Mavec Advisors responded on 10 Nov 2020 that they would look at providing the Pump as a distributor for this procurement. They would need to research future demand for the Pump in order to apply to become an approved source at this time.
