JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
SPRDL1-20-R-0262
1. Contracting Agency: Defense Logistics Agency - DLA Land Warren (DLA-WRN).
2. Description of Action: DLA-WRN proposes to award a new Firm-Fixed-Price contract to Rantec Power Systems, Inc., Commercial and Government Entity (CAGE):
60132, for National Stock Number (NSN) 6120-01-674-9476, Common Power Supply (CPS) with Container, using Army Working Capital Funds (AWCF).
3. Description of Supplies/Services: The NSN 6120-01-674-9476, Part Number (PN) 57K7315, CPS with Container, is used on the M1A2 System Enhancement Program Version 3 (SEPv3) Abrams Tank. The deliverable for this contract is for a base quantity of 323 each, with an option quantity of 323 each, making a total quantity of 646 each.

Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD- STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Reason for Authority Cited: PN 57K7315 (NSN 6120-01-674-9476) contains a primary CPS (PN 12546259) and a Container (PN 19980-2601). The Container can hold the CPS and has a pocket for two units of Desiccant.
There is also an optional power supply LRM Assembly part (PN 12570757) listed on the drawing by a different vendor, however, this optional part is not interchangeable because of different functionality.
The CPS is used on the Hull Control Unit (HCU) (PN 12546134) within the Hull Electrical System on the Chassis Assembly of the M1A2 SEPv3 Tank (NSN 2350-01- 619-5649). The M1A2 SEPv3 version was designed to enhance the existing M1A2 Abrams Tank. The HCU manages power distribution and coordinates functions between the hull and turret, which are the central processing center. The HCU functions as a backup for the turret data processing management system and controls the Load Channels.
The primary component in the CPS is the Line Replaceable Module (LRM) Assembly (PN 12546259) a conduction cooled CPS, 3U VPX DC-DC (circuit card assembly specifying rack unit height, bandwidth, and current requirements), providing power and nuclear event circumvention for the VPX circuit card assemblies installed in the Mission Control Unit (MCU), HCU, and Turret Control Unit (TCU). The major function of the assembly is to convert the supplied input voltage to output voltages per VITA 62 format.
The CPS LRM is a critical item for the Abrams M1A2 SEPV3 tank. The CPS LRM Assembly shall meet all development and qualification requirements specified in document SC-SA21007.
The Government did not buy technical data rights, patent rights or proprietary rights to produce a competitive Technical Data Package (TDP).
The Government does not have specifications, nor a complete build to print TDPs, or proprietary rights.
Rantec Power Systems, Inc. is the Original Equipment Manufacturer of the CPS w/ Container and owns the technical data. Rantec Power Systems, Inc. is the only approved source of supply called out on the CPS w/ Container source-controlled drawings. Rantec Power Systems, Inc. has developed, tested, and passed all qualification testing and obtained Government approval of the CPS w/ Container to be used on the M1A2 SEPv3 at their own cost. The Government did not fund their efforts in developing and testing these items. Additionally, the Government did not fund Rantec Power Systems, Inc. to prepare fully detailed TDPs after approval. As such, Rantec
Power Systems, Inc. is the sole owner of their drawings and technical data rights. The Government does not own the patent rights and proprietary rights to the TDP that would be required to produce a competitive TDP.
Only Rantec Power Systems, Inc. has the capability to manufacture, perform failure analysis, develop inspection and acceptance criteria for components, repair/rebuild and test the CPS w/ Container to meet Government requirements.
This item is sole sourced to Rantec Power Systems, Inc. and no contractor other than Rantec Power Systems, Inc. has been approved to manufacture and sell the primary CPS LRM (PN 12546259). The Government does not own the detailed manufacturing Level III TDP needed for competitive purposes, and it is not available from the sole source manufacturer. In order to compete this procurement action, the Government would have to acquire rights to Rantec Power Systems, Inc.’s detailed manufacturing TDP needed for another vendor to remanufacture the primary CPS LRM and then undergo extensive qualification testing. Rantec Power Systems, Inc. has invested significant resources in the design, establishment of the manufacturing practices, testing and retains the technical rights. The qualified source is required to build the custom military grade CPS LRM in accordance with the performance specification requirements. There is no detailed technical data, TDP Level III, nor manufacturability descriptions available, so the new source will have to have extensive manufacturing experience with the systems in order to complete a new design and manufacturing package.
Unacceptable Delay through Reverse Engineering

a) Without this Level III TDP, U.S. Army Combat Capabilities Development Command Armaments Center (CCDC AC) Engineering estimates that the time to develop a competitive package for this item through reverse engineering would take approximately 24 months. Reverse engineering includes, but not limited to, the following: identify all the deficiencies, conduct market research on available parts and components, work in conjunction with General Dynamics Land Systems (GDLS) (M1A2 SEPv3 Abrams systems integrator) to identify the system’s components and their interrelationships, obtain existing parts, tear down and understand the design, create representations of the system in another form or a higher level of abstraction, create the physical representation of that system and fully define functional parameters, generate Bill of Materials document, build prototype, and then draft a new TDP which would include complete component drawings, performance specifications, and qualification procedures. As stated, this could take at least 24 months to include fabrication and testing of the prototype hardware, and releasing a validated TDP.
b) Since there are no procedures in place to determine whether other sources are qualified to meet Government requirements, it would take an additional 12 months for the U.S. Army, CCDC AC Engineers to develop Government’s requirements for the prospective contractors to manufacture and qualify the primary CPS samples.
c) It would take an additional 18 months to conduct the actual engineering testing/analysis in collaboration between the Government engineers and GDLS system integrator for any additional test equipment or fixtures; component, safety and system level/ higher level assemblies testing or end item systems required to test the CPS, plus, additional time for test facilities and extensive M1A2 SEPv3 Abrams Tank systems tests to ensure proper field operation. The analysis includes conducting the actual verification testing, reviewing the engineering data and preparing a technical report to determine whether or not a new source has successfully met the qualification process and can be added to the referenced drawings.
d) New technical manuals and logistics procedures will be needed for the new primary CPS LRM which will take at least 12 months.
e) An SSP is needed to maintain the test schedule of the Abrams vehicles which will take at least 6 months.
f) The primary CPS LRM of the CPS requires Nuclear Hardness and Survivability Testing (NH&ST). NH&ST includes nuclear testing, physical testing in a simulated environment, modeling, simulation, and analysis. The NH&ST, as well as the Nuclear Survivability Assessment (system analysis test phase, and system level test phase), would be conducted at the U.S. Army Test and Evaluation Command through White Sands Missile Range for nuclear hardness compatibility and survivability. NH&ST is estimated to take at least 6 months.
The aggregate time to reverse engineering the primary CPS LRM; develop qualification procedures/requirements; conducting testing/engineering analysis; logistical development; SSP; NH&ST and qualifying a new source would take an estimated 6.5 years.
If this contract is not in place, an unacceptable delay will occur as it is estimated to take
6.5 years until a new Level III TDP is generated and released. Additional logistics time will require to solicit and qualify potential bidders for this procurement. Considering the complexity of the design and extensive list of the requirements to qualify the CPS, which is a critical item used in the M1A2 SEPv3 version tank, substitute items shall not be allowed without prior testing and approval at any time. Therefore, sole source procurement to Rantec Power Systems, Inc. (CAGE: 60132) is the only method of procurement currently available to ensure supportability of fielded vehicles.
6. Efforts to Obtain Competition:
a. Effective competition: Due to the reasons cited in section 5, the Government is not pursuing competition for this item.
b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan"; and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)”, to maximize small business opportunities and utilization.
SOLE SOURCE: Notices required by FAR 5.201 will be posted.
7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.
No additional actions are being taken to increase competition due to the M1A2 SEPv3 military system complexity and integration requirements.
8. Market Research: A Sources Sought Notice was posted to beta.SAM.gov on 12 March 2021 through 23 March 2021. On 22 March 2021, Aegis Power Systems, Inc. (of Murphy, NC) e-mailed the Contract Specialist stating that their firm has the capability to possibly manufacture this item and expressed interest in future opportunities pertaining to this item. The engineering activity, CCDC AC, was notified of the submission of interest. The firm was provided with the procedures required to be considered for future opportunities for this item.
Between 20 January 2021 and 6 February 2021 CCDC AC Engineer conducted market research by searching internet sources such as Thomasnet, Google, AbilityOne and UNICOR for the customized military grade conduction cooled CPS, 3U VPX.
Rantec Power Systems website was searched to identify specific patents that the sole source manufacturer Rantec Power Systems, Inc. may have related to the military grade conduction cooled common power supply, 3U VPX since there were manufacturers located that produce similar products.
Approval Authority for Acquisitions Equal to or Greater Than $15M and Less Than $100M.
