JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: Defense Logistics Agency - DLA Land Warren.

2. Description of Action: The proposed action is to award a new Firm-Fixed-Price (FFP), one time buy with 100% option contract for the Upgraded Slip Ring Assembly With Container, National Stock Number (NSN) 5977-01-676-1562 for use on the M1A2 System Enhancement Package Version 3 (SEPv3) Abrams Tank. Competition will be limited to Moog Component Group; Commercial and Government Entity (CAGE) 99932.

This action will be funded with Army Working Capital Funds (AWCF).

3. Description of Supplies/Services: The items to be acquired under the proposed contract are new Upgraded Slip Ring Assembly with Container, NSN 5977-01- 676-1562, Government Part Number 57K7327. The estimated unit price is and the base quantity for this contract is 65 units with 100% option with a total quantity of 130 units. The total estimated value of the contract is

100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD- STD-100 definition, altered and selected items shall have an adequate Technical Data Package (TDP), data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 2304(c) (1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: The Upgraded Slip Ring Assembly with Container is a kit (57K7327) that contains the Ring Assembly, Elect (Upgraded Slip Ring Assembly) (United States Government (USG) Part Number: 12592206 / Manufacture Part Number: ED7015-2) and the long-term storage container (Manufacture Part Number: 19980-070). The Upgraded Slip Ring Assembly is the power, fluid, electrical and pneumatic conduit between the vehicle’s hull and turret that represents more than roughly 80% of the cost of the kit. The Upgraded Slip Ring Assembly provides constant transfer of electrical power, fluid power, signals and pneumatic (low-pressure) air from the hull allowing the turret to rotate 360 degrees continuously. The Engineering Change Proposal (ECP) 1 Program requires Legacy Hydraulic and Pneumatic capability along with the addition of increased power, Controller Area Network, Gigabit Ethernet, Isolation for Communications, and Radio Frequency (RF) signal transfer.

This item is source controlled to Moog Component Group (CAGE: 99932). It is a critical item of the M1A2 SEPv3 Abrams for the power, fluid, electrical and pneumatic system and will meet the requirements specific to its intended function in accordance with Source Control Drawing 12592206/19207 and requirements as specified in specification SC-SA19770. A substitute item must not be used without prior approval by the Tank-automotive and Armaments Command (TACOM). This product is a survivability item and is critical for Soldier safety as loss of function of this component would hinder the performance of the turret movability and deteriorate performance in battlefield conditions.

Currently Moog Component Group (CAGE: 99932) is the only approved source to make this item for the Government. This manufacturer is the sole owner of the build to print TDP. Reverse engineering is the only option for the USG to develop a competitive TDP

– which is needed for full and open competition. Reverse engineering is a multi-layered process; it requires the procurement and testing of prototypes and the release of the design. These efforts involve a significant amount of time and money. The USG does not have the funding required to develop and qualify additional sources for this product.

Even if a reverse engineering effort was affordable, this process would incur excessive lead-time delay. A new manufacturer’s prototype needs to be tested in conjunction with the overall electrical system of the M1A2 SEPv3 Abrams Tank. The cost to reverse engineer this unique component is estimated at $10.71M and 66 months to complete.

Reverse engineering the TDP includes, but is not limited to, the following:

X compatible with the Abrams Tank.

Replacement for this component cannot be by a commercial off-the-shelf (COTS) item, and there is no other manufacturer producing this item for the Abrams Tank. This item has been designed by Moog Component Group specifically to meet the M1A2 SEPv3 Abrams Tank unique requirements. Installing hardware that has not undergone similar verifications or qualifications could lead to a failure on the slip ring. Under battlefield conditions, such a failure will render the tank unable to proceed with its mission function and will endanger the lives of the crew.

9. Interested Sources: A Sources Sought Synopsis for this NSN was posted to Beta.Sam.Gov on 31 March 2021. To date, no sources have written to express an interest, nor has the Government identified any other source possessing an interest in being an alternate source for these items.
