J&A SPRDL1-18-R-0306
(Previous J&A not available for Long Term Contract W52H09-04-D-0099)
Defense Logistics Agency Justification and Approval for Other Than Full and
Open Competition
1. Contracting Activity: The United States Defense Logistics Agency - DLA Land Warren is the responsible contracting activity for this action.
2. Description of Action: This request is for approval of a new firm fixed price contract. Funding for this contract will be under Army Working Capital Funds (AWCF). The proposed action is to award a new hardware contract on a sole source basis to SAI Industries, DBA Standard Armament Inc., CAGE 98459, for the procurement of new Ammunition Chutes. The type of contract is firm fixed price, 3-Year, Long Term Contract (LTC).
3. Description of Supplies/Services: This procurement is for Ammunition Chutes in the continued support of the Bradley Fighting Vehicle. The total estimated contract value is for up to 670 Ammunition Chutes. For this contract, the deliverables are as follows:
a. NOUN: CHUTE, AMMUNITION
b. MINIUMUM QUANTITY: 21 EA
MAXIMUM QUANTITY: 670 EA
c. NSN: 1005-01-176-6086
d. MPN: 12328757-2
e. VEHICLE SYSTEM: Bradley (BFVS) - MM
f. ESTIMATED UNIT PRICE:
g. ESTIMATED MINIMUM VALUE:
ESTIMATED MAXIMUM VALUE:
h. PRON NUMBER: EH76R344EH
i. TYPE OF FUNDS: AWCF
j. TYPE OF CONTRACT: Firm-Fixed Price (FFP)
k. ACQUISITION METHOD CODE (AMC): 3 Acquire, for the second or subsequent time, directly from the manufacturer.
l. ACQUISITION METHOD SUFFIX CODE (AMSC): B This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements.
5. Reason for Authority Cited: The services/supplies to be acquired in Paragraph 3 above are for the Bradley Fighting Vehicle 25mm Ammunition chute (P/N 12328757-2) used to feed ammunition to the 25mm main weapon. At this time Standard Armament Incorporated (SAI) (CAGE 98459) is the only qualified supplier of this item. The Government has an incomplete Tech Data Package. Additionally there is no process underway, or funding by which competition can be technically supported in a responsible time frame. To date, SAI has manufactured this item to supply both the vehicle Prime Contractor (BAE) and any previous spares; meeting contractual deadlines consistently. It is estimated to obtain competitive technical data that it would take an additional year after which a breakout contractor would need a year to qualify, and produce spares. It should be noted that during this process, there is no guarantee that a breakout contractor’s item would successfully perform properly, or that production would meet any deadlines. At this time there are no alternative responsible contractors for this item.
6. Efforts to Obtain Competition:
(a) Competition: Based on the detailed rational provided in paragraph 5 above, the Government has no plans to obtain competition for this proposed contractual action.
(b) Subcontracting Competition: FAR clause 52.244-5, Competition in Subcontracting, will be included in the contract to assure that the prime contractor obtains as much competition as possible in its subcontracting.
7. Actions to Increase Competition: As indicated in paragraph 5 above, The Government does not have a means of obtaining adequate information in a responsible time frame, and it should also be noted that funding for such an effort is not presently available. Additionally if funding were to become available it would take an additional 12 months and $15,000 for a competitive TDP and testing requirements to be developed, and another 12 months to obtain spares from a breakout vendor, and perform testing. It should be noted that no cost savings would be realized by competing this requirement.
8. Market Research: The assigned engineering office, RDAR-EIS-CM, conducted computer based market research on 01/11/2018 for the 25mm Ammunition chute, to be used on the Bradley Fighting Vehicle. This research did not produce any related results.
A sources sources sought synopsis for this item was posted in FED BIZ OPPS on or about 01/05/2018 via Sources Sought Notice 2018-175.

(2) Competitive status of these actions.: Sole source to SAI Industries.
(3) Authority previously used for less than full and open competition.: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements.

SAI Industries is the original equipment manufacturer (OEM), and the sole approved source of suppl, for this Ammunition Chute.
c. Subcontracting competition: Contractor SAI Industries is a small business and therefore would not have been required to provide subcontracting information in previous contracts.
