JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

SPRDL1-22-R-0074

1. Contracting Agency: Defense Logistics Agency - DLA Land Warren.

2. Description of Action: DLA Land Warren proposes to award a new Firm-Fixed- Price contract to General Dynamics Mission Systems - Canada (GDMS-C), Commercial and Government Entity (CAGE) 05257, for National Stock Number (NSN) 5999-01-568- 6545, Tactical Display, using Army Working Capital Funds (AWCF). As a Canadian Company, the procurement is made through the Canadian Commercial Corporation (CCC) CAGE 98247 and subcontracted to GDC.

3. Description of Supplies/Services: The NSN 5999-01-568-6545, Part Number (PN)

360558-901 / 12466033-4, Tactical Display, is used on the Bradley Fighting Vehicle System (BFVS). The deliverables for this contract are for a base quantity of 453 each, with an option quantity of 453 each, making a total maximum quantity of 906 each. The total maximum estimated value of this contract is .

The Tactical Display provides color tactical graphics and maps, diagnostics, and status information display. One display is in the turret, one is in the squad area, which provides the A3 crew with enhanced tactical capabilities, and the final display is the driver's display panel.

Acquisition Method Code (AMC):

3 - Acquire, for the second or subsequent time, directly from the actual manufacturer.

Acquisition Method Suffix Code (AMSC):

R - The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 2304(c)(1) as implemented

Previous J&A: SPRDL1-20-C-0089 by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: GDMS-C is the Original Equipment Manufacturer (OEM) and owns the Technical Data Package (TDP) along with the test equipment for the Tactical Display (PN 12466033-4).

The Government does not have rights to the TDP or specifications.

The Government does not have the necessary technical data or testing equipment to support full and open competition and cannot be obtained in a reasonable timeframe.

Due to the requirements for vehicle testing and live fire testing, the redesign would be both time consuming and costly, estimated at approximately $1,750,000. GDMS-C is the only vendor who has demonstrated the capability as identified on the stated drawing. The time and cost to re-engineer the Tactical Display, and provide technical data for the equipment, which is procurable, is estimated at four years with a cost of $6.7 million dollars. It would take approximately two years for another contractor to establish a new TDP. In addition, another six to eight months would be needed to qualify another vendor.

The Government would not be able to recover, through subsequent competition, the duplication of costs involved in either procuring the proprietary data or reverse engineering the item to create a competitive build to print TDP within a reasonable time frame. At the current average usage rate of 323 units each year, a current unit cost of

, and assuming 25% savings achieved through competition, the in annual savings would take over years to offset the estimated $8.5 million in cost of reverse engineering the item and qualifying another source.

6. Efforts to Obtain Competition:

a. Effective competition: Due to the reasons cited in section 5 above the Government is not pursuing competition for this item.

b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan"; and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)”, to maximize small business opportunities and utilization.

SOLE SOURCE: Notices required by FAR 5.201 will be posted.

7. Actions to Increase Competition: There are no plans to increase competition for

There are currently no contractors in the process of being qualified at this time or prior to the contract award due to funding constraints. Accordingly, qualifying a new source would not be in the best interest of the Government at this time.

8. Market Research: The original Sources Sought was posted on the SAM.gov website on 10 February 2021 with no responses, but then subsequently expired (past 12 months old). Due to the original sources sought expiring another Sources Sought notice was posted on 5 April 2022, and was open for 14 days. No responses were received.

Market research was conducted by the U.S. Army, Combat Capabilities Development Command (DEVCOM) - Armaments Center, Rock Island on 15 February - 2 March 2022. An online search was completed using google.com and yahoo.com using the words “Tactical Display”, “Bradley Fighting Vehicle”, "12466033" and “NSN 5999-01- 568-6545”, however there was no direct information matched. The search revealed several manufacturers of displays such as AdvAero, Intellisense INC., Keystone Display and Merivent. Further review revealed that search results were not to the correct specification to meet Government drawing 12466033. Additionally, the tactical displays have not been qualified and/or tested to safely operate on the Bradley Fighting Vehicle or meet the performance metrics and interface requirements. GDMS-C is the only vendor qualified through extensive testing.

DEVCOM - Armaments Center performed market research using the following terms ”Tactical Display" “Bradley Fighting Vehicle” "12466033" and “NSN 5999-01-568-6545”.

The websites found with various tactical displays were: https://www.intellisenseinc.com http://www.adv-aero.com/; and http://www.marinvent.com/ / Multiple tactical displays were found however, none met the drawing and testing requirements of the Tactical Display PN 12466033, which can safely fire the weapon on the Bradley Fighting vehicle.

9. Interested Sources: To date no additional sources have expressed interest in this item.
