FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: Defense Logistics Agency (DLA) Land Warren.
2. Description of Action: The proposed action is to award a contract to Marvin Land Systems (CAGE: 064H2) for National Stock Number (NSN): 5998-01-676-1630;
NOUN: Auxiliary Power Unit (APU) with Container.
The NSN: 5998-01-676-1630, APU with Container, is used on the M1A2 System Enhancement Package Version 3 (SEPv3) Abrams tank.

Acquisition Method Suffix Code (AMSC):
B - This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of Department of Defense Standards, DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate Technical Data Package (TDP), data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is: 10 United States Code (USC) 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “Only One Responsible Source and no other supplies or services will satisfy requirements.”
5. Reason for Authority Cited: The APU for the M1A2 SEPv3 consists of a belt-driven 28-volt (V) generator, a 2-cylinder air-cooled diesel engine, a control box assembly, and a self-contained fuel supply. Power from vehicle batteries is used to drive the APU generator (in starter mode) through controls on the control box assembly.
When in starter mode, the generator turns over the engine through a set of drive V belts. The engine is permitted to warm up, and then the generator is manually switched to load mode to produce electrical charge to vehicle batteries. The 28V Direct Current (DC) generator, driven by the diesel engine, produces an output of 154 to 204 amperes to maintain vehicle battery charge without vehicle engine operation. The APU is a 28V DC nominal power generation subsystem located in the rear left sponson of the M1A2 SEP V3 developed for the purpose of supporting 12 hours continuous silent watch or engine off operation.
The Government does not have complete build to print TDPs nor does it have proprietary data rights to produce technical data needed to compete this item.
Only Marvin Land System has the requisite technical and engineering expertise to perform all efforts required to provide the supplies and services identified in this J&A. A substitute item can not be used without prior approval by TACOM. It is a critical item of the M1 Abrams electrical system and must meet the requirements specific to its intended function in accordance with Source Control Drawing 12591274/19207. This item assembly must meet the requirements and demonstrate compliance to performance, design, test, manufacture, and acceptance as specified in the Product Fabrication Specification (PFS) document SC-SA20450, including testing for compliance with electromagnetic interference and electromagnetic compatibility (EMI and EMR) shielding and nuclear hardening. This product is a survivability item and critical for Soldier safety.
Currently Marvin Land Systems is the only approved source to make this item for the

b. Subcontracting competition:
Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns";
52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages-- Subcontracting Plan";" and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)," to maximize small business opportunities and utilization.
7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above. As stated in section 5 there is no build to print TDP available to support a competitive procurement. This item is source controlled to Marvin Land Systems. This manufacturer owns the technical data and is the only approved source of supply for this item. The Government is not actively pursuing the development of a competitive TDP for future procurements because a significant amount of time and money would be necessary to reverse engineer, procure and test prototypes, and release the design (also stated in section 5).
TACOM Engineering requires successful vehicle level qualification testing to support the approval of a new component; the Government has no plans, or funding, to complete qualification testing at this time.
8. Market Research: Market Research efforts included a Sources Sought/Request for Information posted on the Beta.SAM.Gov website by the Contract Specialist on 15 March 2020. On 24 March 2020, Technology International, Inc. (CAGE: 1RX34) e-mailed the Contract Specialist requesting additional product specifications. Upon further market research and discussions with the Engineering team, and although Technology International has manufacturing capabilities, the only way the contractor would be able to propose on this item (in the future) is if they reverse engineered the part through the Replenishment Parts Purchase or Borrow (RPPOB) process with the TACOM Competition Management Office, and submit a Source Approval Request (SAR) with all pertinent drawings and test information. The reverse engineering, SAR submission, and full vehicle test results of each cylinder would be needed in order to be approved as a secondary source, and all this would have to be on the contractor's cost. On 24 March 2020, the Contract Specialist provided Technology International, Inc. the TACOM Competition Management Office contact information to discuss the process of becoming an approved source.
Online market research was performed by Ground Vehicle Systems Center (GVSC) Engineering during March 2020, by reviewing vendor catalogs, and searching for product literature published online, in effort to find other manufacturers and/or commercial items or non-developmental items that could meet Government needs or could be modified to meet the Government needs. While similar products are produced by several manufacturers, those items are not designed specifically for the M1A2 SEPv3 Abrams tank, nor tested to the M1A2 SEPv3 Abrams' unique requirements to attain qualification, as described in section 5.
