4. Authority Cited: The statutory authority permitting other than full and open competition is Title 10 United States Code (U.S.C.) Section 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements.”

5. Reason for Authority Cited: The Display Units provide vehicle operators of the M109A7 SPH and the M992A3 CAT critical information to perform their mission such as navigation, power management, fire mission data, and camera views as well as vehicle maintenance. The Display Unit allows Soldiers to maneuver the vehicle and maintain situational awareness while safely inside the vehicle. Failure of the Display Unit to operate would result in the Soldier having to leave the vehicle’s interior and therefore exposing themselves to environmental and enemy hazards. The Display Unit is a safety critical item. Failure of the Original Equipment Manufacturer (OEM) to manufacture per Government specifications could result in damage to equipment.

The Display Unit must meet all criteria contained in specification document 12578491, “M109A7 Self-Propelled Howitzer (SPH) and M992A3 Carrier, Ammunition, Tracked (CAT) Driver’s Display Hardware Component Specification”. Document 12578491 defines the performance and verification requirements for the Driver’s Display. Testing requirements necessary to certify a new manufacturer include, but are not limited to, Required States & Modes, System Capability Requirements, Interface Requirements, System Safety Requirements, Security and Privacy Requirements, Environment Requirements, Computer Resource Requirements and System Quality Factors. In addition to these requirements, inspections and tests would be necessary to qualify a manufacturer, these would include First Article Test (FAT), Conformance Test (CT) and Qualification Test (QT) as defined in the Verification section of 12578491. A significant amount of time and money would be necessary to reverse engineer, procure and test prototypes, and release the design. Further, there is no funding to develop and qualify additional Display Unit manufacturers for this effort. Even if a reverse-engineering effort is successful, the Government will incur excessive costs and lead-time delay. The cost to reverse-engineer the critical components is estimated at $2.15M and five years to complete. The prototypes would need to be tested within the vehicles to ensure full system integration, proper data collection, and situational awareness capability. Reverse Engineering the TDP includes, but is not limited to the following:

Management Command, Competition Management Office (CMO), is the lead proponent for the Source Approval Program. While interested Contractors can contact the CMO for assistance with the Source Approval Program, Engineering requires successful vehicle level qualification testing to support the approval of a new source of supply and the Government has no plans or funding to complete qualification testing at this time.

8. Market Research: A web search technical study was performed 24 February 2020 by Ground Vehicle Systems Center (GVSC) Engineering to review cost and competition consideration, along with determining commercial or non-developmental items which may be available to meet Government needs. Characteristics searched included Driver Navigation, Power Management, Fire Mission data and Camera views.

The screening of available manufacturer for possible replacement item conforming to M109A7 form, fit and functional requirements produced no results. GVSC reviewed i2Log and historical ACC Warren procurement data, AMC FORM 1095G for possible suppliers. To date, no other sources have written to express an interest in qualifying as a source of supply.

9. Interest Sources: Sources Sought Notice 2020-001 was posted to Fed Biz Opps (Beta Sam) on 4 December 2019 for the Display Unit, NSN: 7025-01-670-4971, Part Number TACOM 12581798/1026680-901 as required by FAR 5.201. Any responses received will be evaluated by the appropriate office.

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable based on FAR 15.404- 1(b)(2)(vi) and/or 15.404-1(b)(2)(vii). Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable. Based on the estimated dollar value, Certified Cost and Pricing Data will not be required to justify price reasonableness. However, Other Than Certified Cost and Pricing Data may be required in order to establish price reasonableness. The appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary.
