DEFENSE LOGISTICS AGENCY
JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
1. Contracting Activity: The Defense Logistics Agency – Warren (DLA Land Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(2), as implemented by Federal Acquisition Regulation (FAR) 6.302-2, "Unusual and Compelling Urgency."
2. Description of Action: This request is for a new one-time urgent procurement for commercial V3 Transmission Sustainment Kits utilizing Army Working Capital Funds (AWCF) for a firm-fixed-price contract with the only practicable source, Allison Transmission (CAGE Code:
73342).

Acquisition Method Code (AMC) 2: Suitable for competitive acquisition for the first time.
Acquisition Method Code (AMC) 4: Acquire, for the first time, directly from the actual manufacturer.
Acquisition Method Suffix Code (AMSC) G: The Government has rights to the technical data, the data package is complete, and there are no technical data, engineering, tooling or manufacturing restrictions.
Acquisition Method Suffix Code (AMSC) B: This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application.
4. Authority Cited: FAR 6.302-2 Unusual and Compelling Urgency.
5. Reason for Authority Cited: The United States ARMY TACOM Life Cycle Management Command (TACOM LCMC) has an urgent need for the items described above. Items must be procured by the quickest means possible and full and open competition will not achieve the required delivery date. The rationale for citing urgency follows:
An urgent quantity identified for the commercial V3 Transmission Repair Kits, listed above, is required to support the Anniston Production Lines for the ARMY Abrams Transmissions, current and future Abrams V3 tank fieldings, operational requirements and other ARMY priorities in accordance with the Sustainment Readiness Model (SRM). Item Manager validated program requirements with the fielding schedules and deployment of the V3 Abrams Tanks and subsequently the V3 unique transmission embedded within the tank.
These urgent requirements are to support the following programs: Fielding, maintenance, and overhaul of V3 Transmissions which are scheduled for deployment on 28 February 2020 at a quantity of 89 each per brigade. Once V3 tanks are fielded and in use, these kits will be needed to repair broken or unserviceable transmissions. The quantities listed in this Justification & Approval (J&A) represent the minimum requirements until a regular procurement can begin deliveries.
If the required delivery date is not met, the lack of Transmission Repair Kits will result in an out of stock position, line stopper action for Anniston production, and Non-Mission Capable Tanks in the field. This will result in serious financial harm to the Government, potential depot layoffs, and severe impacts to the ARMY’s readiness.
The Transmission Repair Kits are an essential item to the Abrams Transmission and contain all the parts necessary to repair a transmission at the Depot. The Abrams Tank cannot move without the transmission installed. Out of stock position will result in units having Non-Mission Capable Status (NMCS) tanks. Sustaining the readiness of Abrams V3 tanks has high visibility due to increased training requirements and overseas missions. Line stopper actions at Anniston have high visibility and will impact fielding schedules. Moreover, negative stock positions will have a negative effect upon force readiness.
The lack of this item will shut down Anniston's production on multiple M1 Abrams Family of Vehicles Lines (M1 United States Marine Corp (USMC) Overhauls, Abrams Bridging Vehicle (ABV) ARMY, ABV USMC, and Joint Assault Bridge (JAB). The estimated impact will exceed $10M. The estimate provided by Anniston includes, but is not limited to, material requirements.
The Anniston estimate is based on each individual program’s cost; the cost of an individual program includes labor, parts, overhead, and overall sustainability.
6. Efforts to Obtain Competition: Pursuant to FAR 5.202(a)(2), this proposed action will be made under the conditions described in FAR 6.302-2 and the agency will be seriously injured if the agency complies with the time periods specified in FAR 5.203. Therefore, this action will not be synopsized.
7. Market Research: As of this time, Allison Transmission is the only vendor that can successfully deliver the Transmission Kits in the time period specified. No other practicable sources exist that would be capable of meeting the urgent need, as outlined in this justification.
8. Interested Sources: To date, no other sources have written to express an interest in this procurement. As this requirement will not be synopsized, per the exception at FAR 5.202(a)(2), additional interested sources are not anticipated.
9. Other Facts: Urgent procurement is for a one-time buy only.

11. Requirements Certification: I certify that data provided on PRONs EH0C0137EH, EH0C0138EH, EH0C0139EH, EH0C0140EH, EH0C0141EH, EH0C0142EH, and required quantities are accurate and complete.

12. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost for this contract action will be fair and reasonable. Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable. The Sustainment Transmission Kits are considered commercial items and as such Certified cost and pricing data will not be required to justify price reasonableness. However, the appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary.
