DEFENSE LOGISTICS AGENCY J&A: SPRDL1-19-R-0302

(Prior procurement was a simplified procurement and no J&A was required)

Justification and Approval for Other Than Full and

Open Competition

1. Contracting Activity: DLA Land - Warren is the contracting activity responsible for this action.

2. Description of Action: The request is for a new emergency one-time buy to negotiate a firm-fixed-price contract using AWCF funding, with the following source:

Eaton Aerospace LLC

5353 Highland Dr.

Jackson, MS 39206-3449

Eaton Aerospace LLC is considered to be the only practicable source for this procurement, since it is the only source currently in production of the item and is the only known previous supplier.

Any additional supplier would require testing, which would take longer than the required delivery date.

Acquisition Method Code (AMC) for this part is 3: Acquire directly from the actual manufacturer, whether or not the prime contractor is the actual manufacturer.

Acquisition Method Suffix Code: (AMSC) is V: This part has been designated a high-reliability part under a formal reliability program. Probability of failure would be unacceptable from the standpoint of safety of personnel and/or equipment. The cognizant engineering activity has determined that data to define and control reliability limits cannot be obtained nor is it possible to draft adequate specifications for this purpose.

4. Authority Cited: The statutory authority permitting other than full and open competition is 10

U.S.C. 2304(c)(2), as implemented by FAR 6.302-2, "Unusual and Compelling Urgency."

5. Reason for Authority Cited: The United States Army TACOM Life Cycle Management

Command (TACOM LCMC) has an urgent need for the items described above. They must be procured by the quickest means possible since full and open competition will not achieve the required delivery date. The rationale for citing urgency follows:

An urgent quantity of 856ea of NSN 3040-01-119-2774, Shaft, Shouldered, is required to support the Anniston Production Lines for the Axial Piston Pump, operations requirement and other ARMY priorities in accordance with the Sustainment Readiness Model (SRM). This requirement became known on 9 May 2019. The Item Manager validated program requirements with the Maintenance Management Specialist at Anniston Army Depot (ANAD) Drop Out

Factor (DOF) increased to 90% due to wear, scorching, or pitting preventing assets from passing

Overhaul Inspection Procedures (OIP). The quantity to be procured represents the minimum requirement until a normal, non-urgent procurement can be solicited.

This urgent buy is to support the following programs: Axial Piston Pump, USMC, ABV, JAB, Morocco, Kuwait, and KSA. All lines will shut down in February 2020 if we do not receive a delivery by 31 January 2020. In addition, the field will start having vehicles down for this part.

If the required delivery date is not met the lack of the Shaft, Shouldered will result in an out of stock position, line stopper action for Anniston production, shut down of multiple vehicle lines, and subsequently hinder fielding of the end item. This will result in serious financial harm to the

Government, potential depot layoffs, and impacts to the Army’s readiness.

If the required delivery date is not met, the lack of Shaft, Shouldered will affect all Abrams

Family of Vehicles (FOV) divisions. The Shaft, Shouldered is an essential item to the Axial

Piston Pump and ultimately the Tank. The Tank cannot move without the Axial Piston Pump installed. Out of stock position will result in Units having Non-Mission Capable Status (NMCS) tanks. Sustaining the readiness of Abrams tanks has high visibility due to increased training requirements and oversea missions. Line stopper actions at Anniston have high visibility and will impact fielding schedules. Moreover, negative stock positions effect force readiness. A decrease in readiness is likely to have negative political repercussions.

The lack of this item will shut down Anniston's production on multiple M1 Abrams Family of

Vehicles Lines. (M1 USMC Overhauls, ABV Army, ABV USMC, JAB). The estimated impact is over 10 million dollars. The estimate provided by Anniston includes, but is not limited to, Material Requirements. The Anniston estimate is based on each individual program’s cost; the cost of an individual program includes labor, parts, overhead, and overall sustainability.

6. Efforts to Obtain Competition:

a. Eaton Aerospace LLC is the only known successful supplier of this item; Eaton Aerospace

LLC part number 428383.

b. Consistent with the urgency of operational requirements and other priorities according to the

SRM, synopsis is not required for urgent procurements pursuant to FAR 5.202(a)(2).

7. Actions to Increase Competition: As this acquisition is being made under the condition of

”Unusual and Compelling Urgency,” we will not take specific actions to increase competition.

As stated above, the only known supplier, Eaton Aerospace LLC is the only practicable source for this procurement.

8. Market Research: Due to the urgent nature of operational requirements and other SRM based requirements, as outlined in Paragraph 5, we have done limited computer based market research to confirm that no sources other than Eaton Aerospace LLC can produce this item during the required timeframe.

9. Interested Sources: To date, no other sources have written to express an interest in this procurement. As we will not synopsize the requirement, per the exception at FAR 5.202(a)(2), we do not anticipate additional interested sources.

10. Other Facts: Urgency buy is for one-time buy only; no option.

11. Technical Certification: Not Applicable.
