Failure to provide AC Kits in a timely manner would affect unit readiness resulting in HET trucks not being able to meet mission requirements. If these parts are not received promptly, this will cause the units to be unable to perform their mission. Deliveries are required within 90 to 120 days.

Kits are needed to support ongoing mission requirements. Failure to provide these would delay unit deployment, prevent mission completion and cause harm by not having the required AC kits to support and defend our country and interests.

Failure to provide AC kits will limit combatant commanders’ ability to execute national security missions, training for deploying units, and support to allied partners. Safety faults were identified and kits urgently require replacement. If ACs are not replaced this could cause heat exhaustion/ dehydration to the soldier and trucks will be dead-lined.

If these kits are not received promptly this will cause the units to be unable to perform their missions due to dead-lined trucks. There will not be enough HET trucks to perform the mission. This is an essential item and units will not be able to protect allies and defend themselves. This will stop the Army’s mission in deployment locations, contingency operations, and training maneuvers.

Failure to provide these items in the estimated timeframe and to have kits available to load on to Army Prepositioned Stock vessels, the financial detriment to the army will be substantial and could mean the loss of capability within the U.S. Army. At a minimum, additional time and transportation costs will be incurred in moving the kits to the desired location when it is needed.

There is no identical item available currently that can be used in place of this NSN to alleviate the immediate need. Furthermore, there is no item that can be converted to support this requirement.

6. Efforts to Obtain Competition: The Government does not have a complete TDP required to manufacture the kit or use for a competitive procurement and there are no known funding programs active at this time for qualification of additional sources. This is an urgent requirement and only Oshkosh will be solicited for this effort. This effort will not be synopsized in accordance with FAR Part 5.201(a)(2).

7. Actions to Increase Competition: There are no vendors in the process of being qualified for this NSN at this time and none prior to contract award. At this time, there are no current or planned efforts to qualify additional sources due to the fact that the Government does not possess a fully defined and validated TDP for NSN 4120-01-505- 4149. Oshkosh holds the technical data regarding this item. Due to the urgency of this procurement, no further action will be taken to increase competition. Further, the procurement will not be synopsized due to the urgency of the requirement.

8. Market Research: It was determined that commercial or non-developmental items are not readily available to meet the Government's needs. Due to the urgency of this procurement, no further action will be taken to increase competition. No market survey will be conducted. Further, the procurement will not be synopsized due to the urgency of the requirement.

9. Interested Sources: Due to the urgency of this item and FAR 6.302-2, “Unusual and Compelling Urgency” a sources sought notice is not required.

12. Fair and Reasonable Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable. The appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary. The Contractor will not be required to submit certified cost and pricing data based on the estimated dollar value and because this is a commercial item per exception stated in FAR Part 15.403-1(b)(3).
